REGULAR MEETING <br />JUNE 14, 2004 <br />Mr. Aaron Blank, L.S., Project Manager, Abonmarch Consultants, LLC, 750 Lincolnway East, <br />South Bend, Indiana made the presentation for this bill. <br />Mr. Blank advised that the property sought to be annexed is located 1/a mile south of Jackson <br />Road approximately 1,400 feet east of Ironwood Road lying behind Stonehedge Subdivision. <br />The parcel is 36.818 acres in size and currently is agricultural land. The petitioner is proposing a <br />single - family subdivision to be called Deer Hollow, consisting of 36 lots. The substitute version <br />of this bill amends the Statement of Purpose and Intent of the original bill to eliminate the <br />reference to a "voluntary" annexation and it includes a new Section IV., which provides for <br />property tax abatement as authorized by state law. <br />This being the time heretofore set for the Public Hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. <br />There being no one present wishing to speak to the Council either in favor of or in-opposition to <br />this bill, Councilmember Kelly made a motion for favorable recommendation to full Council <br />concerning this bill as substituted, and set for third reading on June 28, 2004. Councilmember <br />Puzzello seconded the motion which carried by a voice vote of eight (8) ayes. <br />BILL NO. 31 -04 PUBLIC HEARING ON A BILL OF THE COMMON <br />COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, <br />AMENDING CHAPTER 21 OF THE SOUTH BEND <br />MUNICIPAL CODE TO CORRECT THE CROSS - <br />REFERENCES IN ARTICLES 12, 13, AND 14; TO <br />AMEND ARTICLE 2, RESIDENTIAL DISTRICTS <br />TO ALLOW PUBLIC PARKS, ACTIVE, AS <br />ALLOWABLE USES IN THE SINGLE FAMILY <br />AND TWO FAMILY AND MULTIFAMILY ZONING <br />DISTRICTS; TO AMEND ARTICLE 8 SPECIAL <br />REGULATIONS, SECTION 21 -08.02 SPECIAL <br />REGULATIONS FOR CONTROLLED USES; AND TO <br />AMEND ARTICLE 7 GENERAL REGULATIONS, <br />SECTION 21 -07.03 (f) OFF - PREMISE SIGNS <br />Councilmember Kuspa, Chairperson, Zoning & Annexation Committee, reported that this <br />committee held a meeting this afternoon and it was the consensus of the committee to send this <br />bill to the full Council with a favorable recommendation. <br />Mr. Jeff Myers, Staff Planner, Area Plan Commission, 1805 Hickory Road, South Bend, Indiana, <br />presented the report from the Commission, and made the presentation for this bill. <br />Mr. Myers advised that the purpose of this ordinance is to make several amendments to the <br />recently adopted zoning ordinance. Some of these amendments simply correct cross references <br />in those sections that were not amended, while other amendments deal with changes to the <br />billboard section, to the location restriction of public parks, and to allow certain controlled uses <br />in the downtown and East Bank area. <br />This being the time heretofore set for the Public Hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. <br />There being no one present wishing to speak to the Council either in favor of or in opposition to <br />this bill, Councilmember Varner made a motion for favorable recommendation to full Council <br />concerning this bill. Councilmember Kuspa seconded the motion which carried by a voice vote <br />of eight (8) ayes. <br />12 <br />
