REGULAR MEETING SEPTEMBER 13,2004 <br /> BILL NO. 45-04 PUBLIC HEARING ON A BILL OF THE COMMON <br /> COUNCIL OF THE CITY OF SOUTH BEND, <br /> INDIANA, SETTING THE ANNUAL SALARY FOR <br /> THE CITY CLERK FOR CALENDAR YEAR 2005 <br /> City Clerk John Voorde, stated that he requested to withdraw this bill to allow for the <br /> filing of the Mayor and City Clerk Salary Ordinance together as has been past practice. <br /> Councilmember Coleman advised that there has been a request by the petitioner to <br /> withdraw this bill from consideration. Therefore, Councilmember Kirsits made a motion <br /> to withdraw this bill. Councilmember Dieter seconded the motion which carried by a <br /> voice vote of nine (9) ayes. <br /> BILL NO. 51-04 PUBLIC HEARING ON A BILL OF THE COMMON <br /> COUNCIL OF SOUTH BEND, INDIANA, FIXING <br /> THE ANNUAL PAY AND MONETARY <br /> FRINGE BENEFITS OF FIREFIGHTERS OF THE <br /> SOUTH BEND FIRE DEPARTMENT FOR CALENDAR <br /> YEAR 2005 <br /> Council President Karen White made a motion to hear the substitute version of this bill. <br /> Councilmember Kirsits seconded the motion which carried by a voice vote of nine (9) <br /> ayes. <br /> Councilmember Puzzello, Chairperson, Health &Public Safety Committee, reported that <br /> this committee met on this bill this afternoon and voted to send it to full council with a <br /> favorable recommendation. <br /> Councilmember Al `Buddy" Kirsits, Councilmember at Large, disclosed that he is a <br /> member of the South Bend Fire Department and after discussing this matter with Council <br /> Attorney Kathleen Cekanski-Farrand that they concur that there is no conflict of interest <br /> in this matter. <br /> Kathleen Cekanski-Farrand, 914 E. Jefferson Boulevard, South Bend, Indiana made the <br /> presentation for this bill. <br /> Mrs. Cekanski-Farrand advised that the South Bend Common Council has the legal <br /> responsibility pursuant to Indiana Code §36-8-3-3 (d) to establish by ordinance before <br /> September 20th, the annual compensation of all members of the South Bend Fire <br /> Department. She further advised that on April 26, 2004, the Common Council <br /> unanimously adopted Resolution No. 3324-04 which appointed an agent/negotiator and <br /> addressed an Advisory City Negotiating Team. The Advisory City Negotiating Team <br /> was composed of 1St District Councilmember Derek D. Dieter, 3rd District <br /> Councilmember Roland Kelly, 4th District Councilmember Ann Puzzello, 6th District <br /> Councilmember Ervin Kuspa, Assistant Fire Chief Rick Switalski, City Controller <br /> Frederick B. 011ett III, city Attorney Charles S. Leone, Agent/Negotiator for the Board of <br /> Public Safety, and Kathleen Cekanski-Farrand, Agent/Negotiator for the South Bend <br /> Common Council. The Fire Negotiating Team was composed of Captain Michael J. <br /> Damiano, Engineer Kenneth Marks, Captain Jess (Ben)Noell,Engineer Michael <br /> Jamieson,Lieutenant/Paramedic Todd Skwarcan, Pump Engineer James Weinberg, <br /> Michael Wegenka, retired Battalion Chief; and Thomas F. (Chip) Lewis, III, <br /> Agent/Negotiator. The negotiating teams were committed to using interest-based <br /> bargaining techniques and after a series of positive negotiating sessions; a tentative <br /> agreement was reached on July 29, 2004. Mrs. Cekanski-Farrand presented a power- <br /> point presentation a copy of which is on file in the Office of the City Clerk. Mrs. <br /> Cekanski-Farrand indicated that the entire proposed Collective Bargaining Agreement <br /> 6 <br />
