F. Switching or adulterating any urine sample submitted for testing or submitting a false sample <br />for testing. <br />G. Refusing consent to testing or refusing to submit a urine sample for testing when required by <br />an Alpine Demolition representative or by representatives of any Alpine Demolition customer, <br />vendor, or supplier. <br />H. Being indicted or convicted under any criminal drug statute for a violation occurring in the <br />workplace or outside the workplace. <br />I. Failing to notify Alpine Demolition of any incident or conviction under any criminal drug <br />statute within 5 days of the event. <br />J. Failing to comply with rules and regulations promulgated under any testing programs <br />maintained by Alpine Demolition pursuant to such rules and regulations. <br />Authorized Use of Prescribed Medicine <br />A. An employee undergoing prescribed medical treatment with any drug or controlled substance <br />that may impair his or her physical or mental ability should report this treatment to Alpine <br />Demolition Human Resources Department, which will determine whether Alpine Demolition <br />should temporarily change the employee's job assignment during the period of treatment. <br />Testing <br />A. Alpine Demolition has established a testing program for illegal drugs and controlled <br />substances for all employees and will, in its sole discretion, determine (and may at any time <br />change) the requirements extent, and frequency of employee testing. <br />B. All samples collected under this program will be Analyzed by a SAMHSA certified laboratory, <br />and shall include an initial Enzyme Multiplied Immunoassay Screening Test (EMIT) and, when <br />necessary, confirmed by a Gas Chromatography/Mass Spectrometry (GC/MS) Confirmation <br />Test. Said testing must screen, as a minimum, for the following substances and below the <br />following levels to result in a negative test. <br />C. Alpine Demolition , prior to taking any action, will give all employees who test positive the <br />opportunity to explain in writing the test results. <br />1- Failure of any employee to establish adequately a legal basis for the use of any drug or controlled <br />substance with respect to which the employee tests positive shall constitute a violation of this <br />policy. An MRO (Medical Review Officer) maybe used to verify "positive" results at the discretion <br />of the company. <br />D. Alpine Demolition will establish and maintain any and all additional testing programs and <br />requirements that may be necessary or appropriate to comply with applicable rules and <br />regulations of all Government agencies. <br />Testing Options <br />A. Probable Suspicion/Reasonable Cause Testing <br />1- Alpine Demolition will require a drug and/or alcohol test for an employee when there is <br />"probable suspicion" that the employee cannot safely perform his or herjob and could potentially <br />be under the influence of a prohibited drug and/or alcohol in violation of this policy. <br />2- The employee will be asked/required to sign the consent form. <br />
