Contractoragreesthathe/she/itshallenrollinandverifytheworkeligibilitystatusofallofContractor’snewlyhiredemployeesthroughtheB-VerifyProgramasdefinedbyIC.22-5-17-3.Contractor’sdocumentationofenrollmentandparticipationintheB-VerifyProgramisincludedandattachedaspartofthisbidlquote;and5.Contractorshallrequirehisther/itssubcontractorsperformingworkunderthispubliccontracttocertif’thatthesubcontractorsdonotknowinglyemployorcontractwithanunauthorizedalien,norretainanyemployeeorcontractwithapersonthatthesubcontractorsubsequentlyleanisisanunauthorizedalien,andthatthesubcontractorhasenrolledinandisparticipatingintheB-VerifyProgram.TheContractoragreestomaintainthiscertificationthroughoutthetermoftheconb-actwiththeCityofSouthBend,andunderstandsthattheCitymayterminatethecontractfordefaultiftheContractorfailstocureabreachofthisprovisionnolaterthanthirty(30)daysafterbeingnotifiedbytheCity.6.Persons,firms,partnerships,corporations,associations,orjointventurersawardedacontractbytheCityofSouthBendthroughitsagencies,boards,orcommissionsshallnctdiscriminateagainstanyemplcyeeorapplicantforemploymentintheperformanceofaCitycontractwithrespecttohire,tenure,terms,conditions,orpnvilegesofcontractcremployment,oranymailerdirectlyorindirectlyrelatedtocontractingoremploymentbecauseofrace,sex,religion,color,nationalorigin,ancestry,genderexpression,genderidentity,sexualorientation,orduetoageordisabilitythatdoesnotaffectthatperson’sabilitytoperformthework.Inawardingcontractsforthepurchaseofwork,labor,services,supplies,equipment,matenals,cianycombinationoftheforegoingincluding,butnotlimitedto,publicworkscontractsawardedunderpublicbiddinglawsorothercontractsinwhichpublicbidsarenotrequiredbylaw,theCity,itsagencies,boards,orcommissionswillconsidertheContractor’sgoodfaitheffortstoobtainparticipationbythosesubcontractorscertifiedbytheStateofIndianaasaMinorityBusiness(“1E”)orasaWomen’sBusinessEnterprise(“WEB”)asafactorindeterminingthelowest,responsible,responsivebidder.ContractorsseekingtheawardofaCitycontractcannotberequiredtoawardasubcontracttoanMWBE;however,theymaynotunlawfullydiscriminateagainstsaidMBEiWBE.Ongoal-eligiblecontracts,ContractorsarerequiredtoeithermeetbothIvIBEandWBEutilizationgoalsordemonstratethattheContractorhasmadegoodfaitheffortstoobtainparticipationfromMBBandWEEsubcontractors.AfindingofnoncomplianceoradiscriminatorypracticeshallprohibitthatContractorfrombeingawardedaCitycontractforaperiodofone(1)yearfromthedateofsuchdetermination,andsuchdeterminationmayalsobegroundsforteirriinatingthecontacttowhichthediscriminatorypracticeornoncompliancepertains.7.TheundersignedContractoragreesthatthefollowingnondiscriminationconmiitnientshallbemadeapartofanycontractwhichitnayhenceforthenterintowiththeCityofSouthBend,Indianaoranyofitsagencies,boardsorcommissions.Contractoragreesnottodiscriminateagainstorintimidateanyemployeeorapplicantforemploymentintheperformanceofthiscontractwithprivilegesofemployment,oranymatterdirectlyorindireotlyrelatedtoemployment,becauseofrace,religion,color,sex,genderexpression,genderidentity,sexualorientation,handicap,nationaloriginorancestryBreachofthisprovisionmayberegardedasmaterialbreachofcontract.I,theundersignedbidderoragentascontractoronapublicworksprojectunderstandmystatutoryobligationstotheuseofsteelproductsorfoundryproductsmadeintheUnitedStates(IC.5-16-8-1).Therebyce±’thatIandallsubcontractorsemployedbymeforthisprojectwillusesteelproductsorfoundryproductsmadeintheUmtedStatesonthisprojectifawarded.IunderstandIhaveanaffinnativedutytonoti’theCityinmybidthatmyproposaldoesnotincludetheuseofsteelproductsorfoundryproductsmadeintheUnitedStates.runderstanditismysoleobligationandresponsibilitytoprovideajustificationtotheCity,subjecttoreviewandapproval,whythecostofUnitedStatesmadesteelorfoundryproductsisunreasonable.PriortoawardanduponsubmissionofbidwhichdoesnotusesteelproductsorfoundryproductsmadeintheUnitedStates,theCity,throughitsdirectorofpublicworks,shallmakeadeterminationifthepriceofUnitedStatesmadesteelorfoundryisunreasonable.Iunderstandthatviolationshereunder
