Exhibit D <br /> Additional Terms <br /> A. The following additional terms in this Paragraph A are[NOT]applicable to the Loan: <br /> "Equivalency Project" shall mean a project designated by the Finance Authority as an <br /> "equivalency project" under the Safe Drinking Water Act related to the "US Environmental <br /> Protection Agency Capitalization Grant for Drinking Water State Revolving Funds" for the <br /> federal fiscal year ending September 30, 2022 (or such later federal fiscal year as the Finance <br /> Authority may otherwise designate). <br /> "BIL" shall mean the Bipartisan Infrastructure Law (BIL) (P.L. 117-58), also known as the <br /> "Infrastructure Investment and Jobs Act of 2021"(IIJA), signed into law on November 15,2021. <br /> The Participant understands and acknowledges that the Project has been designated as an <br /> Equivalency Project and is required to meet the related applicable requirements of the Safe <br /> Drinking Water Act. <br /> The Participant further understands and agrees that it is required to comply with all terms of 2 <br /> CFR 200.216, Prohibition on certain telecommunication and video surveillance services or <br /> equipment, which among other requirements prohibits the use of Loan proceeds by the <br /> Participant to procure (by means of entering into, extending, or renewing contracts) or obtain <br /> equipment, systems or services that use"covered telecommunications equipment or services" <br /> identified in the regulation as a substantial or essential component of any Drinking Water <br /> System, or as critical technology as part of any Drinking Water System. Such prohibitions <br /> extend to the use of Loan proceeds by the Participant to enter into a contract with an entity that <br /> "uses any equipment, system, or service that uses covered telecommunications equipment or <br /> services" as a substantial or essential component of any Drinking Water System, or as critical <br /> technology as part of any Drinking Water System. The Participant represents and warrants that <br /> it has not procured or obtained from Loan proceeds equipment, systems or services that use <br /> "covered telecommunications equipment or services" identified in the regulation as a <br /> substantial or essential component of any Drinking Water System, or as critical technology as <br /> part of any Drinking Water System. <br /> The Participant further understands and agrees that it shall comply with all federal <br /> requirements applicable to the assistance received(including those imposed by BIL)which the <br /> Participant understands includes, but is not limited to, the following requirements: that all of <br /> the iron and steel,manufactured products, and construction materials used in the Project are to <br /> be produced in the United States("Build America, Buy America Requirements")unless (i)the <br /> Participant has requested and obtained a waiver from the cognizant Agency pertaining to the <br /> Project or the Project is otherwise covered by a general applicability waiver, or (ii) all of the <br /> contributing Agencies have otherwise advised the Participant in writing that the Build <br /> America, Buy America Requirements are not applicable to the Project. <br /> The Participant further understands and agrees that it shall comply with all record keeping and <br /> reporting requirements under all applicable legal authorities, including any reports required by <br /> the Finance Authority or the Agency, such as performance indicators of program deliverables, <br /> information on costs and progress of the Project. The Participant understands that (i) each <br /> contract and subcontract related to the Project is subject to audit by appropriate federal and <br /> state entities and (ii) failure to comply with the applicable legal requirements and this <br /> Agreement may result in a default hereunder that results in a repayment of the Loan in advance <br /> of the maturity of the Bonds,termination and/or repayment of grants, cooperative agreements, <br /> direct assistance or other types of financial assistance, and/or other remedial actions. <br /> The Participant further understands and agrees that it shall comply with (i) Executive Order <br /> 14030, regarding Climate-Related Financial Risk and (ii) Executive Order 13690, regarding <br /> Flood Risk Management Standards. <br /> The Participant further understands that the Project is being financed, in whole or in part, with <br /> BIL funds, and shall place a physical sign displaying the official Building a Better America <br /> emblem and Agency logo at the site of the Project. <br /> D-- 1 - <br />
