MEMORANDUM OF UNDERSTANDING <br />This Memorandum of Understanding (this "MOU") is made on February 27, 2024 , 2024 (the <br />"Effective Date") and sets forth the agreement between the City of South Bend, Indiana (the <br />"City"), and Teamsters Local Union No. 364, affiliated with the International Brotherhood of <br />Teamsters of America (the "Union") (collectively, the "Parties"). <br />RECITALS <br />WHEREAS, the Parties entered into a Master Agreement ("Agreement") to provide for <br />equitable and peaceful adjustment of differences which may arise, further a mutual and voluntary <br />effort to promote and maintain sound labor relations, and to establish other conditions of <br />employment for the calendar years 2022-2024; and <br />WHEREAS, the Common Council of the City of South Bend, Indiana ("Common Council") <br />passed Ordinance Number 7997-89 on July 24, 1989, fixing the maximum wages and monetary <br />fringe benefits for Teamsters Union employees of the City for the calendar years 1990 through <br />1992. Further, each subsequent contract cycle, the Common Council has passed an ordinance <br />fixing the maximum wages for Union employees. Prior to the most recent budget cycle, Council <br />most recently passed an ordinance fixing maximum wages for Union employees on October 10, <br />2022 in Ordinance Number 10893-22 for calendar year 2023 (the "Salary Ordinance"); and <br />WHEREAS, conditions since the adoption of the 2023 Salary Ordinance have changed so <br />as to warrant additional compensation for certain Teamster positions in the 2024 Salary <br />Ordinance, particularly within the Equipment Services Work Group. As a result of these <br />conditions, the City desires to increase the wages of the Building Maintenance, General Laborer, <br />Machinist IV and V, Mechanic III, IV, and V, and Parts Clerk I and II positions to bring these <br />wages more in line with the private sector in order to retain and attract employees in these roles; <br />and <br />WHEREAS, the City of South Bend Common Council adopted many of these increases in <br />Ordinance Number 10980-23 on October 9, 2023; and <br />WHEREAS, the Parties mutually desire to amend the Agreement to include these updated <br />wage rates for 2024 and agree that any wage rates not currently reflected in Ordinance Number <br />10980-23 shall be updated through the City's filing of an amended Salary Ordinance. <br />NOW, THEREFORE, the Parties agree as follows: <br />1. The Agreement, particularly the Equipment Services Supplemental, shall be <br />amended to include the following wage rates. The City will file an amended Salary Ordinance <br />requesting that the Common Council amend the Salary Ordinance to the extent that any of <br />these rates are not currently reflected in Ordinance Number 10980-23. <br />
