REGULAR MEETING MARCH 26, 2013 90 WHEREAS, it has been determined by the Board of Public Works that the following property is unfit for the purpose for which it was intended and is no longer needed by the City of South Bend: NINETY -SEVEN (97), MORE OR LESS, M26 POLICE TASERS THIRTY -FIVE 35 MORE OR LESS FIRST MOBILE LAPTOP DOCKING STATIONS FOR DELL D260 LAPTOP COMPUTERS WHEREAS, Indiana Code 5 -22 -22 permits and establishes procedure for disposal of personal property which is unfit for the purpose for which it was intended and which is no longer needed by the City. NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South Bend that the item listed above are no longer needed by the City and/or are unfit for the purpose for which they were intended and have an estimated combined value of less than five thousand dollars ($5,000.00). BE IT FURTHER RESOLVED that said items may be transferred or sold at public auction or private sale, without advertising. Martin, Clerk ADOPT RESOLUTION NO. 132013 — A RESOLUTION OF THE CITY OF SOUTH BEND INDIANA BOARD OF PUBLIC WORKS, APPROVING A GRANT AGREEMENT WITH INDIANA DEPARTMENT OF ENVIRONMENTAL MANAGEMENT CONCERNING REDUCTION OF EMISSIONS RELATED TO CITY -OWNED EQUIPMENT Upon a motion made by Mr. Mecham, seconded by Mr. Inks and carried, the following Resolution was adopted by the Board of Public Works: RESOLUTION NO. 13 -2013 A RESOLUTION OF THE CITY OF SOUTH BEND, INDIANA BOARD OF PUBLIC WORKS APPROVING A GRANT AGREEMENT WITH INDIANA DEPARTMENT OF ENVIRONMENTAL MANAGEMENT CONCERNING REDUCTION OF EMISSIONS RELATED TO CITY -OWNED EQUIPMENT WHEREAS, the City of South Bend, Indiana, Board of Public Works (the "Board ") is the contracting body for the City of South Bend, Indiana ( "City ") pursuant to Indiana Code § 36-9- 6; and WHEREAS, the City and Indiana Department of Environmental Management ( "IDEM ") desire to enter into an agreement whereby IDEM intends to award the City funds for use in certain environmental matters as they are described in the agreement ( "Project "), a copy of said agreement being attached hereto and incorporated herein as Exhibit A ( "Grant Agreement"); and WHEREAS, the Board approves the Grant Agreement as shown at Exhibit A and hereby expresses its desire to enter into any other documents recommended by legal counsel as necessary to effect such transaction (collectively, the "Documents "); and WHEREAS, the Board recognizes that the Grant Agreement and the Documents are
