ORDINANCE NO. 7379-J&9e AN ORDINANCE ESTABLISHING A SCHEDULE OF RATES AND CHARGES FOR SERVICES RENDERED BY THE WASTEWATER TREATMENT PLANT OF THE CITY OF SOUTH BEND AND AMENDING CHAPTER 17, ARTICLE 5 AND 6 BY AMENDING SECTION 17 -47, 17 -47.1, AND 17 -49(a) STATEMENT OF PURPOSE AND INTENT: The Common Council of the City of South Bend last estab- lished a schedule of rates and charges for services rendered by the Wastewater Treatment Plant of the City of South Bend and for the water service fund to repair water service line leaks by Ordinance No. 6828 -80, adopted on September 15, 1980. Prior to September 15, 1980 the Common Council of the City of South Bend last established a schedule of rates and charges for services rendered by the Wastewater Treatment Plant of the City of South Bend by Ordinnce No. 5299 -71, adopted on June 14, 1971. Prior to Ordinance No. 6828 -80, charges for the water service fund to repair water service line leaks were established by Ordinance No. 5930 -75, adopted on December 15, 1975. Section 17 -47(c) of Article 5 of the Municipal Code of the City of South Bend requires that the Common Council review on a regular basis all rates and charges for services rendered by the Wastewater Treatment Plant at least every four years, and it has now been approximately four years since the passage of Ordinance No. 6828 -80. The Council now finds that in order to meet the financial requirements of the Wastewater Treatment Plant and of the water service fund, it is necessary that the rates and charges for the services be established as set forth below. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, as follows: SECTION 1. Section 17 -47 of Article 5 of the Municipal Code of the C 'ity of South Bend, shall be amended in its entirety to read as follows: 17 -47 Definitions: As used in this article: (a) A family dwelling unit means a building, vehicle or movable structure or portion thereof designed or arranged to provide temporary or permanent living facilities for a single family.
