• <br /> BILL NO. <br /> ORDINANCE NO. 7.5' ,;4--g5-' <br /> AN ORDINANCE TO AMEND CHAPTER 2 , ARTICLE <br /> 17 , SECTION 2-205 COMMONLY KNOWN AS FEES <br /> CHARGED FOR LEGAL ADVERTISEMENTS OF THE <br /> MUNICIPAL CODE OF THE CITY OF SOUTH BEND, <br /> INDIANA <br /> STATEMENT OF PURPOSE AND INTENT <br /> On January 28 , 1985, the Common Council passed Ordinance No. <br /> 7428-85, which amended the Tax Abatement procedures. <br /> Included within that Ordinance was a section establishing <br /> a filing fee of $150. 00. The fee was based upon an in-house study <br /> conducted by the City of the costs incurred by the City to comply <br /> with all required legal publications for such actions. <br /> The following ordinance amends the current Section addressing <br /> legal advertisement costs so that it is consistent, and includes <br /> fees for petitions for impact areas. <br /> NOW, THEREFORE, BE it ordained by the Common Council of the <br /> City of South Bend, Indiana, as follows : <br /> SECTION I. Chapter 2, Article 17, Section 2-205 of the <br /> Municipal Code of the City of South Bend, Indiana is amended to read <br /> as follows : <br /> Sec. 2-205 Fees charged for legal advertisements. <br /> (a) All petitioners seeking tam-abatements; voluntary <br /> annexations , vacation of public ways, or rezonings , <br /> except those rezonings petitioned for by the Area <br /> Plan Commission or a member of the Common Council, <br /> shall remit the sum of one hundred dollars ($100. 00) <br /> at the time of filing said petition. Said sum is <br /> non-refundable and shall be used to fulfill all legal <br /> advertisement requirements of such proceedings <br /> incurred by the City. <br /> (b) All petitioners seeking tax abatements or impact <br /> area designations,except those impact areas petitioned <br /> for by a member of the Common Council, shall remit <br /> the sum of one hundred and fifty dollars ($150. 00) at <br /> the time of filing said petition. Said sum is non- <br /> refundable and shall be used to fulfill all legal <br /> advertisement requirements of such proceedings incurred <br /> by the City. <br /> SECTION II.
