Vance <br /> Members of the Common Council <br /> Council Chambers <br /> County-City Building, 4th Floor <br /> South Bend, Indiana 46601 <br /> RE: ALLEY VACATION: 1ST E/W ALLEY SOUTH OF SOUTH <br /> BEND AVENUE RUNNING NORTHEASTERLY FROM THE EAST <br /> RIGHT-OF-WAY OF JACOB STREET <br /> Dear Members of the Council : <br /> In accordance with Municipal Code Section 18 . 53 . 8 , a <br /> favorable recommendation is being submitted to the Common <br /> Council concerning the Vacation Petition filed by Mr. John <br /> Firth, Attorney at Law, on behalf of his clients Jack and <br /> Lois Powell, 1713 South Bend Avenue, South Bend, Indiana, <br /> to vacate the first fourteen (14) foot east/west alley, <br /> south of South Bend Avenue, running northeasterly from the <br /> west right-of-way of Jacob Street for a distance of 167 . 5 <br /> feet more or less to a dead-end, abutting lots 1, 2 and 3 <br /> of Parker and Allens Addition and Lot S of Parker and Allens <br /> Replat, City of South Bend, St. Joseph County, Indiana. <br /> For your information, a Public Hearing concerning this <br /> proposed vacation was held on October 21, 1985 . As required <br /> by ordinance, owners whose property abut the proposed alley <br /> to be vacated were notified of the Board' s Public Hearing <br /> date. Mr . John Firth was present on behalf of his clients , <br /> the Powell ' s , and spoke in favor of the vacation. No one <br /> was present to speak against the Petition and no written <br /> objections were filed with the Board. A copy of the excerpts <br /> of the minutes of the Public Hearing is attached for your <br /> information. <br /> Based on favorable comments received from the Engineering <br /> Department and Area Plan Commission, the Board of Public Works <br /> favorably recommends vacation of the above referred to alley <br /> subject to any and all utility easements . <br />
