BILL NO. <br /> ORDINANCE NO. 7s4f':1,,s <br /> ORDINANCE OF THE COMMON COUNCIL <br /> OF THE CITY OF SOUTH BEND, INDIANA, <br /> AMENDING CERTAIN PORTIONS OF CHAPTER 17 <br /> OF THE MUNICIPAL CODE OF SOUTH BEND, INDIANA, <br /> COMMONLY KNOWN AS SEWERS AND WATER <br /> STATEMENT OF PURPOSE AND INTENT: <br /> The City of South Bend has been ordered by the United States <br /> Environmental Protection Agency to develop and implement a program for <br /> the pretreatment of industrial waste . Pursuant to that mandate , an <br /> Industrial Pretreatment Program has been developed and has received the <br /> approval of both the United States Environmental Protection Agency and <br /> the Indiana State Board of Health. A proposed Sewer Use Ordinance was <br /> a part of that approved plan and the Common Council now desires to <br /> adopt that Ordinance in order to bring the City of South Bend into <br /> compliance with federal requirements. <br /> SECTION I. Chapter 17, Section 17-5 of the Municipal Code of <br /> South Bend is amended as follows : <br /> Sec . 17-5 Definitions : <br /> (-s-) As used in this article : <br /> ( 1) BOARD means the City of South Bend acting through its <br /> Board of Wastewater Commissioners . <br /> (1) (2) BOD (denoting biochemical oxygen demand) means the <br /> quantity of oxygen utilized in the biochemical oxidation of organic <br /> matter under standard laboratory procedure in five ( 5) days at twenty <br /> ( 20) degrees Celsius, expressed in milligrams per liter. <br /> (-2-) (3 ) BUILDING DRAIN means that part of the lowest <br /> horizontal piping of a drainage system which receives the discharge <br /> from soil , waste, and other drainage pipes inside the walls of the <br /> building and conveys it to the building sewer, beginning five (5) feet <br /> ( 1.5 meters) outside the inner face of the building wall . <br /> ( 3) (4) BUILDING SEWER means the extension from the building <br /> drain to the public sewer of other place of disposal . <br /> (-14-) (5) CITY ENGINEER means the City Engineer of the City, or <br /> his authorized deputy, agent or representative . <br /> ( 6) CFR means Code of Federal Regulations . <br /> (-5-) (7) COMBINED SEWER means a sewer receiving both surface <br /> runoff and sewage . <br /> (8) EFFLUENT DATA means information necessary to determine <br /> the identity, amount, frequency, concentration, temperature, or other <br /> characteristics of any pollutant discharged . <br /> (9) EPA means The U.S. Environmental Protection Agency or a <br /> duly authorized official of that agency. <br />
