( 8) Compliance schedule reports must be submitted by <br /> any nonresidential discharger not subject to Categorical Standards who <br /> is not in compliance with the terms and conditions of this Ordinance . <br /> (j ) Emergency Suspension of Service and Permit. <br /> The Board of Wastewater Commissioners may for good cause <br /> shown suspend the wastewater treatment service and the Discharge Permit <br /> of a nonresidential discharger when an actual or threatened discharge <br /> presents or may present an imminent or substantial danger to the health <br /> or welfare of persons, substantial danger to the environment, interfere <br /> with the operations of the wastewater treatment plan, or violate any <br /> pretreatment limits imposed by this Ordinance . Any nonresidential <br /> discharger notified of the suspension of treatment service and/or <br /> permit shall cease all discharges to the sewer system. In the event of <br /> failure of the nonresidential discharger to comply voluntarily with the <br /> suspension order within the specified time, the Board of Wastewater <br /> Commissioners shall commence judicial proceedings immediately <br /> thereafter to compel the Nonresidential User ' s compliance with such <br /> order. <br /> (k) Revocation of Permit. <br /> The Board of Wastewater Commissioners may revoke the permit <br /> of a nonresidential discharger which fails to : <br /> ( 1) Notification of Violation; Administrative <br /> Adjustment. <br /> Whenever the Board of Wastewater Commissioners finds that a <br /> Permittee has engaged in conduct which justifies revocation of its <br /> Permit, pursuant to Section 17-33 (k) hereof, the Board shall serve or <br /> cause to be served upon such Permittee a written notice by certified <br /> mail , return receipt requested, stating the nature of the alleged <br /> violation. Within fifteen ( 15) days of the date of receipt of the <br /> notice, the permittee shall respond in writing to the Board of <br /> Wastewater Commissioners advising of its position with respect to the <br /> allegations. Thereafter the parties shall meet within 15 days to <br /> establish a plan for the satisfactory correction of all confirmed <br /> violations. <br /> (m) Show Cause Hearing . <br /> Where the violation of Section 17-33(1) hereof is not <br /> corrected by timely compliance by means of Administrative Adjustment, <br /> the Board of Wastewater Commissioners may order any discharger which <br /> causes or allows conduct prohibited by Section 17-33(1) hereof, to show <br /> cause before the Board or its duly authorized representative, why the <br /> proposed permit revocation should not be taken. A written notice shall <br /> be served on the discharger by personal service, certified or <br /> registered , return receipt requested, specifying the time and place of <br /> a hearing to be held by the Board or its designee regarding the <br /> violation, the reasons why the enforcement action is to be taken, the <br /> proposed enforcement action, and directing the discharger to show cause <br /> before the Board or its designee why the proposed enforcement action <br /> should not be taken. The notice of the hearing shall be served not <br /> less than 10 days before the hearing. Service may be made on any <br /> agent, officer, or authorized representative of a discharger . The <br /> proceedings at the hearing shall be considered by the Board which shall <br /> then enter appropriate orders with respect to the alleged improper <br /> activities of the discharger. <br /> (n) Judicial Proceedings . <br />
