The cost to prepare boundary survey drawings and mark lot corners for both is <br /> $1,800. Staff recommends approval of the proposal for a total cost of$7,375. <br /> Upon a motion by Ms. Schey, seconded by Mr. Alford and unanimously carried, the <br /> Commission approved the proposal from Danch Harper& Associates for the scope of <br /> services and fee proposed. (Oliver Plow Works Industrial Park Final Subdivision and <br /> Survey) <br /> (5) Request to approve an exception to the Blackthorn Corporate Park Covenants for <br /> minimum lot size. (Lot 1, Davita F.J. Nimtz Parkway Minor Subdivision) <br /> Mr. Relos noted that in August 2012, Lot 2CC of the Blackthorn Corporate Office Park <br /> Minor 94, First Replat, was subdivided into four smaller lots, to accommodate the sale of <br /> one of these lots for new development by Daivta, Inc. <br /> When this approximately 8 %2 acre lot was subdivided and platted, one lot was inadvertently <br /> made slightly smaller than two acres (1.83). According to the Blackthorn Covenants, <br /> Article 4.8, lots in the Corporate Office park area must be at least two acres. <br /> Article 3.5 of the Covenants addresses how exceptions are to be handled. Since the <br /> Commission owns more than 5% of Blackthorn, a written request to the Commission must <br /> be made, with action taken within 60 days. <br /> Staff requests this memo be considered its written request to the Commission, to approve <br /> Lot I of the Davita F.J. Nimtz Parkway Minor as platted, being +/- 1.83 acres. As a <br /> courtesy, the Board of Directors of the Blackthorn Owners Association has been notified of <br /> this action, with no objections. <br /> Upon a motion by Mr. Alford, seconded by Mr. Varner and unanimously carried, the <br /> Commission approved the exception to the Blackthorn Corporate Park Covenants for <br /> minimum lot size. Nimtz Parkway Minor Subdivision) <br /> (6) Update on Unity Gardens @ LaSalle Square <br /> Mr. Relos noted that since 2009, Unity Gardens has had a community garden at La Salle <br /> Square on Commission owned property. This garden has grown in scope and outreach in <br /> each successive year, and now includes a growing hoop for four-season growing, a covered <br /> 8 <br />
