• <br /> BILL NO. <br /> ORDINANCE NO. 7 3-, <br /> ORDINANCE OF THE COMMON COUNCIL <br /> OF THE CITY OF SOUTH BEND, INDIANA, <br /> AMENDING SECTION 17-33 <br /> OF THE MUNICIPAL CODE OF <br /> SOUTH BEND, INDIANA <br /> STATEMENT OF PURPOSE AND INTENT; <br /> The sole purpose of this ordinance is to include in Chapter <br /> 17 certain necessary language which was inadvertently omitted when <br /> Ordinance No . 7515-85 was passed by the Common Council . <br /> Section I . Chapter 17, Article 2, Division 5, Section 17-33 <br /> of the Municipal Code of South Bend is amended as follows : <br /> Sec . 17-33 (k) Revocation of Permit . <br /> The Board of Wastewater Commissioners may revoke the permit <br /> of a nonresidential discharger which fails to : <br /> ( 1) factually report the wastewater constituents and <br /> characteristics of its discharge z <br /> ( 2) report significant changes in wastewater consituents or <br /> characteristics , including periods of noncompliance with applicable <br /> effluent limitations ; <br /> (3) report modifications of operational and/or pretreatment <br /> processes or facilities ; <br /> ( 4) refuses reasonable access to the Nonresidential User ' s <br /> premises by representatives of the wastewater treatment plant for the <br /> purpose of inspection or monitoring ; or <br /> ( 5) violates the conditions of this Ordinance or any final <br /> judicial order entered with respect thereto . <br /> Section II. This Ordinance shall be in full force and effect <br /> after passage by the Common Council, approval by the Mayor and legal <br /> publication. <br /> / <br /> ' ember of the Com n Council <br />
