authenticated and delivered, and all property hereby pledged is to be dealt with and disposed of under, upon and subject to the ' terms, conditions, stipulations, covenants, agreements, trusts, uses and purposes as hereinafter expressed; and the Authority has agreed and covenanted, and does hereby agree and covenant, with the Trustee and with the respective owners, from time to time, of ' the said Bonds or any part thereof, as follows: ARTICLE I. ' Definitions Sec. 1.01. The terms defined in this Article I shall, for ' all purposes of this Agreement, and any agreement supplemental hereto, have the meanings herein specified, unless the context otherwise requires: ' (a) "Agreement" or "this Agreement" means this instrument, either as originally executed or as it may from ' time to time be supplemented, modified or amended by any supplemental agreement entered into pursuant to the provisions of this Agreement. ' (b) "Authority" means the South Bend Redevelopment Authority, a body corporate and politic, or any successor entity. (c) "Bond" or "Bonds" (unless the context shall otherwise require) means any Bond or Bonds, or all the Bonds, as the case may be, authenticated and delivered under this Agreement. (d) "Board" means the Board of Directors of the Authority. (e) "Bondholder," "holder," "owner" and "registered owner" means the registered owner of a Bond. (f) "Code" means the Internal Revenue Code of 1986, as amended. (g) "Commission" means the South Bend Redevelopment Commission, or if said commission shall be abolished, the commission, board, body or agency succeeding to the principal functions thereof. (h) "Construction Fund" means the Construction Fund created and established by Section 3.02. (i) "Costs of Issuance" shall mean any and all costs and expenses relating to the issuance, sale and delivery of E-3
