ORDINANCE NO. --7 (,,o 3 -- 8'b <br /> AN ORDINANCE TO VACATE THE NORTH-SOUTH STREET <br /> COMMONLY KNOWN AS GREENLAWN AVENUE, BETWEEN RUSKIN <br /> AND NORTHSIDE BOULEVARD LOCATED NEAR I.U.S.B. , AND A <br /> PORTION OF HILDRETH STREET. <br /> STATEMENT OF PURPOSE AND INTENT <br /> The vacation of the above described streets is for the purpose of <br /> initiating the first phase in the development of a landscaped quadrangle <br /> which will serve as the central core and unifying element of the IUSB <br /> campus around which future university development will occur. The new <br /> 5-story library complex will be developed as a focal point at the south <br /> terminus of the quadrangle. <br /> Pursuant to Indiana Code Section 36-7-3-12, the Common Council is <br /> charged with the authority to hear all petitions to vacate public ways or <br /> public places within the City. <br /> The following Ordinance vacates the above described property. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF <br /> SOUTH BEND, INDIANA, as follows : <br /> SECTION I. The Common Council of the City of South Bend having held a <br /> public hearing on the petition to vacate the following property: <br /> THE NORTH-SOUTH STREET KNOWN AS GREENLAWN AVENUE (66-FOOT R.O.W. ) <br /> BETWEEN THE SOUTH R.O.W. LINE OF RUSKIN STREET AND THE NORTH R.O.W. <br /> LINE OF NORTHSIDE BLVD. , BOUNDED ON THE EAST BY THE INDIANA UNIVERSITY <br /> AT SOUTH BEND (IUSB) CAMPUS AND ON THE WEST BY LOTS 9-24, INCLUSIVE, <br /> OF MIKESELL'S ADDITION (IUSB PROPERTY) , THE HILDRETH STREET R.O.W. AND <br /> THE U.S. ARMY RESERVE CENTER (CITY PROPERTY) ; AND, <br /> THE EAST 190.11 FEET OF THE EAST-WEST STREET KNOWN AS HILDRETH STREET <br /> (40-60 FOOT R.O.W. ) BETWEEN AN EXTENSION OF THE WEST LOT LINE OF LOT <br /> 115 OF THE BELLEVUE ADDITION AND THE WEST R.O.W. LINE OF GREENLAWN <br /> AVENUE, BOUNDED ON THE NORTH BY LOT 115 OF THE BELLEVUE ADDITION, A <br /> VACATED 14-FOOT NORTH-SOUTH ALLEY AND LOT 21 OF MIKESELL'S ADDITION <br /> (ALL IUSB PROPERTY) AND ON THE SOUTH BY LOT 116 OF THE BELLEVUE <br /> ADDITION (IUSB PROPERTY) , A PUBLICLY DEDICATED 14-FOOT NORTH-SOUTH <br /> ALLEY AND LOT 22 OF MIKESELL'S ADDITION (IUSB PROPERTY) . <br /> hereby determines that it is desirable to vacate said property. <br /> SECTION II. The City of South Bend hereby reserves the rights and <br /> easements of all utilities and the Municipal City of South Bend, Indiana <br /> to construct and maintain any facilities, including, but not limited to, <br /> the following: electric, telephone, gas, water, sewer, surface water <br /> control structures and ditches, within the vacated right-of-way, unless <br /> such rights are released by the individual utilities. <br /> SECTION III. The following property may be injuriously or <br /> beneficially affected by such vacating: <br /> A. No property will be injuriously affected, since additional <br /> right-of-way will be provided and a cul-de-sac constructed at the <br /> east terminus of Hildreth Street and dedicated for public use. <br /> B. All Indiana University at South Bend (IUSB) property on both <br /> sides of the requested vacated Greenlawn Avenue and Hildreth <br /> Street R.O.W. 's will be beneficially affected by the development <br />
