„' d~ <br />WHEREAS, the Redevelopment Authority has or will adopt a <br />resolution substantially identical to this Resolution to effectuate the <br />transfer of the Real Property from the Airport Authority to the <br />Redevelopment Authority. <br />NOW, THEREFORE, BE IT RESOLVED BY THE ST. JOSEPH COUNTY AIRPORT <br />AUTHORITY AS FOLLOWS: <br />1. That in consideration of the sum of Ten Dollars ($10.00) and <br />other good and valuable consideration, the transfer by the Airport <br />Authority to the Redevelopment Authority of the following described <br />property, situated in St. Joseph County: <br />A parcel of land 80 feet in width, located in the <br />Southeast Quarter (SE 1/4) of Section 20, the South <br />Half (S 1/2) of Section 21, and the North Half (N <br />1/2) of Section 28, Township 38 North, Range 2 <br />East, German Township, St. Joseph County, Indiana, <br />the boundaries of which lie 40 feet on each side of <br />a centerline and .centerline extended, said <br />centerline described as follows: <br />Commencing at the Southwest corner of the Southeast <br />Quarter (SE 1/4)-of Section 20; thence North. <br />OOo19'S3" West, along the West line of said Quarter <br />Section, 2135.00 feet; thence North 89040'07" East <br />78.50 feet to the True .Point of Beginning of this. <br />description; thence North 89°40'07" East 1185.91 <br />feet. to a point of curvature of a tangent curve to <br />the Right having a radius of 1600.00 feet and a <br />central angle of 28000'06"; thence southerly and <br />easterly along said curve 781.96 feet to the West <br />line of the property described in Deed Record <br />7818352, Recorded the 25th day of August, 1978, of <br />.the Records of St. Joseph County, Indiana. <br />Containing 3.85 acres, more or less, <br />(hereinafter referred to as the "Real Property") shall be, and hereby <br />is approved and ordered done. <br />2. That the Real Property shall be transferred to the <br />Redevelopment Authority by quit-claim deed, executed by the President, <br />and attested to by the Secretary of the St. Joseph County Airport <br />.Authority. <br />3. That transfer by the Airport Authority shall be made to the <br />Redevelopment Authority in an "as is" condition with no warranties, <br />indemnities or representations made by the Airport.
