APPENDIX D <br />Contractor Monitoring Procedures <br />In order to assure a contractor's compliance with DOT'S regulations, the following procedures <br />are to be followed in determining compliance with the drug and alcohol misuse testing <br />regulations as set forth in 49 CFR Part 382 and 49 CFR Part 40 Subpart C: <br />Procedures for Determining Compliance <br />1. Qualifying Potential Contractor(s). Qualifications of the potential contractor as <br />it pertains to drug and alcohol testing, education and training policies/procedures <br />is assured by requesting the potential contractor to submit a copy of its Drug and <br />AMPP for review and compliance with FHWA/DOT regulations. After review of <br />the policies is completed, written correspondence to the contractor will advise it <br />whether or not the plans are acceptable or in need of further additions, deletions, <br />revisions or clarifying language. The review of the contractor plan shall be <br />completed utilizing the criteria established in the FHWA Inspection forms. <br />Addendums made to the contractor's plans shall be attached to the previously <br />submitted Drug and AMPP plan. Upon approval of the addendum, a letter of <br />acceptance is then sent to the contractor. The contractor is now eligible to bid on <br />Trisco Systems, Inc. contract work that would be covered under Parts 382 and 40. <br />2. Monitoring Contractor's Compliance. The contractor may be required to <br />provide information on their employees who will perform covered functions for <br />Trisco Systems, Inc.. This information may include the name and job title of its <br />employees who will perform any work or functions covered by Part 382 under <br />that contract. A list of each contractor's covered employees may be distributed to <br />appropriate Trisco Systems, Inc. field management personnel and job sites. <br />3. Statistical Submission. All contractors will be required to submit Drug and <br />AMPP testing statistical information on a periodical basis which may be based on <br />the duration of the contract. Typically this requirement will be conducted on a <br />monthly or quarterly basis. Trisco Systems, Inc. may require a more frequent <br />schedule for submission of data should they determine a need for such statistics. <br />4. Statistical Record Retention. Trisco Systems, Inc. shall maintain a complete file <br />on each contractor's statistical drug and alcohol testing data reports. Trisco <br />Systems, Inc. shall make available these reports when requested by the FHWA <br />Administrator, designated representative, authorized customer representative, or <br />representatives of those state agencies under which jurisdiction Trisco Systems, <br />Inc. operates. <br />64 <br />
