3. Trisco Systems, Inc. may require a covered employee to submit to drug follow up <br />testing when the substance abuse professional has reason to suspect drug <br />involvement. The drug testing must comply with the requirements contained in <br />49 CFR Part 40, Subpart A. <br />Provisions Governing Retesting of Covered Employees <br />1. A covered employee tested and found to have an alcohol concentration of 0.02 or <br />greater but less than 0.04 shall not be permitted to perform or continue to perform <br />covered functions until: <br />a. The start of the employee's next regularly scheduled duty period, <br />but not less than 24 hours following administration of the alcohol <br />test. <br />2. Except as provided above, Trisco Systems, Inc. shall not take any action under 49 <br />CFR Part 382 against a covered employee based solely on test results showing an <br />alcohol concentration less than 0.04. However, this does not prohibit Trisco <br />Systems, Inc. from taking any disciplinary action otherwise consistent with local <br />and/or state law. <br />Alcohol Prohibited Conduct <br />Trisco Systems, Inc. shall provide guidance to all covered employees regarding the <br />various types of alcohol prohibited conducts. <br />Alcohol Concentration <br />A covered employee shall be prohibited from reporting for duty or remaining on duty requiring <br />the performance of covered functions while having an alcohol concentration of 0.04 or greater. <br />If a Trisco Systems, Inc. representative has actual knowledge that a covered employee has an <br />alcohol concentration of 0.04 or greater, the employee shall not be permitted to perform or <br />continue to perform covered functions. <br />Pre Duty Use <br />Trisco Systems, Inc. shall prohibit a covered employee from using alcohol within 4 hours prior <br />to performing covered functions, or if an employee is called to duty to respond to an emergency, <br />within the time period after the employee has been notified to report for duty. If Trisco Systems, <br />Inc. has actual knowledge that a covered employee has used alcohol within 4 hours prior to <br />performing covered functions or within the time period after the employee has been notified to <br />report for duty, the employee shall not be permitted to perform or continue to perform covered <br />functions. <br />42 <br />
