22 <br />unauthorized us of any opium, opiate or opium derivative. (This requirement <br />does not apply if the GC/MS confirmation testing for opiates confirms the <br />presence of 6-monocetylmorphine). [40.33(d)] <br />7 The MRO shall notify each employee who has a confirmed positive test that the <br />employee has 72 hours in which to request a test of the split specimen, if the test <br />if verified as positive. If the employee requests an analysis of the split specimen <br />within 72 hours of having been informed of a verified positive test, the MRO shall <br />direct, in writing, the laboratory to provide the split specimen to another DHHS <br />certified laboratory for analysis. If the analysis of the split specimen fails to <br />reconform the presence of the drug(s) or drug metabolite(s) found in the primary <br />specimen, or if the split specimen is unavailable, inadequate for testing or <br />untestable, the MRO shall cancel the test and report cancellation and the reasons <br />for it to the DOT, the Company, and the employee. <br />8 If an employee has not contacted the MRO within 72 hours as provided above, the <br />employee may present to the MRO information documenting that serious illness, <br />injury, inability to contact the MRO, lack of actual notice of the verified positive <br />test, or other circumstances unavoidably prevented the employee from timely <br />contacting the MRO. If the MRO concludes that there is a legitimate explanation <br />for the employee’s failure to contact the MRO within 72 hours, the MRO shall <br />direct that the reanalysis of the primary specimen or analysis of the split <br />specimen, as applicable, be performed. <br /> <br />Re-analysis Authorized <br /> <br />Should any question arise as to the accuracy or validity of a positive test result, only the Medical <br />Review Officer is authorized to order a re-analysis of the original sample and such retests are <br />authorized only at laboratories certified by DHHS. The MRO shall authorize a re-analysis of the <br />original sample if requested to do so by the employee within 72 hours of the employee’s having <br />received actual notice of the positive test. If the retest is negative, the MRO shall cancel the test. <br /> <br />Result Scientifically Insufficient <br /> <br />The MRO, based on review of inspection reports, quality control data, multiple samples, and <br />other pertinent results, may determine that the result is scientifically insufficient for further <br />action and declare the test specimen negative. In this situation the MRO may request re-analysis <br />of the original sample before making this decision. (The MRO may request that re-analysis be <br />performed by the same laboratory or, that an aliquot of the original specimen be sent for re- <br />analysis to an alternate laboratory which is certified in accordance with DHHS Guidelines.) The <br />laboratory shall assist in this review process a requested by the MRO by making available the <br />individual responsible for day to day management of the urine drug testing laboratory or another <br />employee who is a forensic toxicologist or who has equivalent forensic experience in urine drug <br />testing, to provide specific consultation. <br /> <br /> <br /> <br />
