10 <br />The authority for DOT drivers’ drug testing is derived from the Omnibus Transportation <br />Employee Testing Act of 1991 and is conducted in accordance with the U.S. Department of <br />Transportation’s Drug Testing Procedures Rules: 49 CFR Part 40. The remainder of Trisco <br />Systems Inc., employees are designated Safety-sensitive Employees by Company policy. <br /> <br />Drug Testing Circumstances <br /> <br />In order to improve the health of employees and help provide a safer workplace, the Company <br />will conduct drug testing. All applicants and “covered” employees will be tested under the <br />following circumstances: <br /> <br />1 Pre-Placement Testing: Applicants for positions will be required to submit to drug <br />testing. Positive results for any of the drugs screened will result in that applicant’s <br />disqualification for employment. Due to the nature of employment conditions, the <br />Company may conduct Pre-Placement testing for a period prior to employment up to (30) <br />days past hire date. <br /> <br />2 Post-Accident Testing: As soon as possible after an accident (but not later than 32 hours <br />after an accident), the Company will drug test any employee whose performance either <br />contributed to the accident or cannot be completely discounted as a contributing factor to <br />the accident. If an employee is injured, unconscious, or otherwise unable to evidence <br />consent to the drug test, all reasonable steps (listed below) must be taken to obtain a urine <br />sample. Management may decide not to test under this paragraph, but such a decision <br />must be based on the best information available immediately after the accident that the <br />employee’s performance could not have contributed to the accident or that, because of the <br />time between that performance and accident, it is not likely that a drug test would reveal <br />whether the performance was affected by drug use. <br /> <br />POST ACCIDENT TESTING SHALL BE DONE: <br />(a) On any surviving driver [who was performing safety sensitive functions with <br />respect to the vehicle], of any motor vehicle involved in an accident, if the <br />accident involved the loss of human life; (b) Who receives a citation under State <br />or local law for a moving traffic violation arising from the accident; (c) Who, in <br />the judgement of Trisco administration, has been involved in a high potential <br />incident involving chemical or heavy equipment handling, or during critical <br />procedure work, while that person was performing safety sensitive functions with <br />respect to the incident. <br /> <br />The Company must take all reasonable steps to obtain a urine sample from an employee <br />following an accident. In the case of a conscious, but hospitalized employee, the <br />supervisor should request that the hospital or medical facility obtain the sample from the <br />employee. If an employee is injured, unconscious (employee is unable to <br />communicate), or otherwise unable to evidence consent (employee is unable to sign <br />custody and control form) to the drug test, all reasonable steps must be taken to obtain a <br />urine sample from the employee.
