7 <br />The Company does not prohibit employees from using prescription drugs while “on the job” or <br />on Company premises, provided: (a) the prescription drugs are prescribed for medical reasons <br />by a licensed medical practitioner; and (b) the employee’s use of prescription drugs does not <br />adversely affect job performance or threaten the property, safety or reputation of the Company <br />or other employees. The use of prescription drugs by employees while “on the job” or on <br />Company premises shall be only in the manner, combination and quantity prescribed. The <br />Company reserves the right to require submission to a fitness for duty exam and/or apply the <br />disciplinary procedures of this policy to any employee who abuses prescription drugs in a <br />manner which adversely affects job performance or threatens the property, safety or reputation <br />of the Company and other employees. <br /> <br />The Company prohibits employees from using over-the-counter drugs while on the job or on <br />Company premises where such use: (a) adversely affects the employee’s job performance; or (b) <br />threatens the property, safety or reputation of the Company or other employees. The Company <br />may apply the disciplinary procedures of this policy to any employee who uses over-the-counter <br />drugs in a manner which violates either (a) or (b) of this paragraph. <br /> <br />Being subject to the effects of an illegal drug or alcohol does not excuse an employee’s <br />misconduct which may violate any Company rule or policy. <br /> <br />MEDICAL MARIJUANA. <br /> <br />The State of Ohio legalized the use of Medical Marijuana effective September 8, 2018. The law <br />authorized medical marijuana use by patients with 21 conditions, including cancer or chronic <br />pain, in the form of edibles, oils, patches and vaporizing. Smoking is barred. <br /> <br />The Ohio Code is clear in stating that the medical marijuana law does not affect how employers <br />choose to establish and monitor drug use and testing policies for their employees. Trisco <br />Systems, Inc. maintains its right to retain a drug, marijuana and alcohol-free workplace. <br />Therefore, Trisco Systems, Inc. will continue to test our employees for marijuana use, and to <br />enforce policies that terminate, discipline, and/or refuse to hire individuals who have been using <br />marijuana and fail drug testing policies as described here-in. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
