5 <br />Trisco Systems, Inc. <br />Drugs, Marijuana and Alcohol Policy <br />Purpose: Business Necessity <br /> <br />Trisco Systems, Inc. recognizes the adverse effects that abuse of drugs, marijuana and alcohol <br />can have on an employee’s job performance and on our entire work environment. Additionally, <br />Trisco Systems has the responsibility of complying with the Department of Transportation Drug <br />and Alcohol Testing Procedures for DOT licensed drivers. We have chosen to include all <br />employees we deem “safety sensitive” in our program. For your reference, italic print refers to <br />Trisco Systems, Inc., Company Policy; standard block print refers to DOT specific policy <br />which we are choosing to adopt for all designated, affected employees. <br /> <br />The Company is legally responsible for providing a safe work environment. The Company also <br />has a legal right to maintain a drug, marijuana and alcohol-free workplace. In light of the <br />Company’s legal rights and responsibilities, the Company expects all employees to refrain from <br />being under the influence of illegal drugs, marijuana or alcohol while on the job or on Company <br />premises. The Company also expects Trisco Systems, Inc., employees to refrain from using, <br />possessing, selling, purchasing, receiving or distributing illegal drugs, marijuana or alcohol <br />while on the job or on Company premises, and to refrain from off-the-job abuse of illegal drugs, <br />marijuana and alcohol which adversely affects job performance or threatens the property, safety <br />or reputation of the Company or other employees. <br /> <br />Trisco Systems, Inc., has adopted this Fitness for Duty Policy in order to maintain a safe and <br />efficient workplace and to ensure a drug, marijuana and alcohol-free environment. The Fitness <br />for Duty Policy is an addendum to the current Employee Handbook. Nothing in this Fitness for <br />Duty Policy alters, amends, or modifies the existing employment at will status of all Trisco <br />Systems, Inc., employees. Trisco Systems, Inc., and its employees may terminate their <br />employment relationship at any time, with or without notice, and for any or no reason not <br />contrary to law. <br /> <br />The Drug, Marijuana and Alcohol Fitness for Duty Policy is necessary to: <br /> <br /> Maintaining the safety of trucking and other safety sensitive operations by establishing a <br />drug and alcohol free environment thereby minimizing the possibility of a drug or <br />alcohol related operational accident; <br /> Provide direction to employees with substance abuse problems; <br /> Comply with the Department of Transportation Mandatory Drug and Alcohol Testing <br />Programs, The Drug Free Workplace Act of 1986, and other applicable federal safety <br />programs. Ensure the effective performance of employees; <br /> Guard against liability resulting from the actions of employees; <br /> Protect Company property and other employees against theft by persons who steal to <br />support a substance abuse habit; <br /> Deter illegal activities; <br /> Provide an effective deterrent against pressure to experiment or continue use of <br />deleterious compounds. <br />
