Page 1 of 2 <br /> <br /> <br /> <br />INTER-OFFICE MEMORANDUM <br /> <br /> DEPARTMENT OF PUBLIC WORKS <br /> DIVISION OF ENGINEERING <br />TO: Theresa Heffner, Clerk <br />Board of Public Works <br />FROM: Zach Hurst, PE, Sr. Project Engineer <br /> <br />SUBJECT: Award Bid - Project No. 122-034 <br />Fire Station #8 Replacement <br />DATE: 08/30/2023 <br />On July 25, 2023, the Board of Public Works opened and read bids for the above project. <br /> <br />Four bids were received, from R Yoder Construction, Larson Danielson Construction, Gibson- <br />Lewis LLC, and Brown & Brown General Contractors. The base bid option is a one-bay fire <br />station. The alternate bid is for a two-bay fire station, which would accommodate an additional <br />medical response vehicle. <br /> <br />A breakdown of the bids is as follows: <br /> <br />Contractor: R Yoder <br />Construction <br />Gibson Lewis Larson <br />Danielson <br />Brown & Brown <br />Base Bid: $3,363,200 $3,764,000 $3,858,000 $3,948,000 <br />Alternate Bid: $3,703,850 $4,066,000 $4,113,000 $4,351,000 <br /> <br />I recommend award of the alternate bid (two-bay option) for Fire Station #8 Replacement to R <br />Yoder Construction, in the amount of $3,703,850.00. Funding is available through PR- <br />00025426. <br /> <br />The R Yoder bid contained three irregularities which warrant discussion. <br />1. Its bid included a Clarifications sheet (attached); however, the Clarifications sheet did <br />not impact the bid price, nor deviate from the project Specifications. The City is awarding <br />this project strictly based on the specifications and what R Yoder offered. <br />2. Its bid also included a non-collusion affidavit which listed R Yoder’s representative but <br />did not include a signature. It is the belief of the City that the lack of signature does not <br />disqualify the bid and that no competitive advantage was received through this omission. <br />The City believes that this was akin to a Scribner’s error and seeks to correct the record <br />with the attached executed affidavit. <br />3. Its bid did not meet the MWBE Goal requirements. An explanation of R Yoder’s MWBE <br />effort is below. A good faith waiver is being granted based upon the City’s internal team <br />who reviewed R Yoder’s bid and its supporting documentation which it presented in the <br />bid and upon request of the City. <br /> <br /> <br /> <br />
