JONES ��LERK, SO�!!j_ BEND, IN--- <br />Re: AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY <br />OF SOUTH BEND, AMENDING CHAPTER 6, ARTICLE 13, <br />SECTIONS 6-71 THROUGH 6-78 ADDRESSING RESPONSIBLE <br />BIDDING PRACTICES AND SUBMISSION REQUIREMENTS ON <br />PUBLIC WORKS PROJECTS <br />Dear Council Members: <br />On April 9, 2018, the Common Council passed Ordinance No. 10594-18, <br />"An Ordinance of the Common Council of the City of South Bend, Indiana, <br />amending Chapter 6 of the South Bend Municipal Code to Include New <br />Article 13 Establishing Responsible Bidding Practices and Submission <br />Requirements on Public Works Projects." The Bill was crafted through the <br />collaboration of City Government, the Chamber of Commerce, Union <br />Trades, and other key stakeholders. <br />After more than four years operating under the original ordinance, the <br />proposed amendments represent improvements and updates to the original <br />ordinance to reflect current circumstances and to ensure that the highest <br />quality of standards continue to be utilized during the bidding process. Like <br />the original bill, these amendments were also crafted through the <br />collaboration of City Government, the Chamber of Commerce, Union <br />Trades, and other key stakeholders. <br />These amendments retain existing responsible bidding practices and <br />submission requirements by contractors on Public Works projects and <br />continue to comply with state law to award capital improvement contracts to <br />the "lowest responsive and responsible" bidder. This ordinance continues to <br />reflect the factors the city will consider in determining a responsive bidder <br />and updates the factors the city will consider in determining a "responsible" <br />bidder. <br />BILL NO. 61-23
