u <br />~~ <br />WHEREAS,. pursuant to L.C, 36-7-14.5-12(a)(5) and (4), the <br />• Redevelopment Authority may acquire and hold real property needed or <br />considered useful in connection with local public improvements; and <br />WHEREAS, pursuant to I.C. 8-22-3-10, the Airport Authority is <br />authorized to acquire and dispose of-real property far use or in <br />connection with ar far administrative purposes of the airport; and <br />WHEREAS, .the Airport Authority is desirous of transferring title <br />to the Real. Property to the South Bend Redevelopment Authority <br />(hereinafter, the "Redevelopment Authority"} sa that the same may be <br />utilized for the construction of F. J. l~imtz Parkway,.east of <br />Mayflower Road..; and <br />WHEREAS, the Redevelopment Authority is desirous of acquiring the <br />Real Property from the Airport Authority in order to allow for the <br />construction of this portion of F, J. Nimtz Parkway; and <br />WHEREAS, by Resolution No. 33, adopted March 8, 1991, th.e <br />Redevelopment Authority has elected to abide by the previsions of I.C. <br />36-1-11-8 with regard to the transfer by ar to it of real property to <br />or from another governmental entity; and <br />WHEREAS, the Airport Authority has or-will adopt a resolution <br />substantially identical to this Resolution to effectuate the transfer <br />of the Real Estate from the Airport Authority to the Redevelopment <br />Auth©rity. <br />• .NOW, THEREFORE,. BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT <br />AUTHORITY AS FOLLOWS: <br />1. That in consideration of the sum of Ten Dollars ($10.00) and. <br />other good and valuable consideration paid to the Airport Authority by <br />the Redevelopment Authority, the transfer from the Airport Autho-city <br />to the Redevelopment Authority of the following described property,. <br />situated in St. Joseph County: <br />A part of the Southeast Quarter (SE 1/4) of <br />Section 20, the South Half (S 1/2) of Section 21, <br />and the North Half (1/2) of Section 28, Township <br />38 North, Range 2-East, German Township, St. <br />Joseph County, Indiana., mare particularly <br />described as follows: <br />Commencing at the Southwest corner of the <br />Southeast Quarter (SE 1/4) of Section 20; thence- <br />North 00°19' 53" West, along the West- line of sa.d <br />quarter section., 2135,00 feet; thence North <br />89°4Q'07" East 78.50 feet to the True.
