INTER-OFFICE MEMORANDUM

DEPARTMENT OF PUBLIC WORKS
DIVISION OF ENGINEERING

TO: Theresa Heffner, Clerk
Board of Public Works
FROM: Gemma Stanton
SUBJECT: 2023 Curb and Sidewalk Pro 123-001 Bid Award
DATE: August 14, 2023
On August 8th, 2023, the Board of Public Works opened and read bids for the above project.

The bids were priced as follows:

Bidder Division A Division B Division C Division D Division E
1. Premium
Concrete $64,949.00 $335,583.00
$246,378.00 $157,478.00 $169,030.00
2. Milestone
Contractors $80,708.00 $363,759.00
$260,908.00 $196,380.00 $187,591.00
3. Rieth-Riley
Construction $78,602.86 $368,102.45
$273,320.71 $163,253.90 $190,076.35
4. Selge
Construction $99,863.90 $411,994.85
$301,145.05 $214,084.50 $204,750.65

All bidders completed the Non-Collusion Affidavit and acknowledged the addendum.
Bid paperwork contained multiple scrivener’s errors on page 13 (Form WBE-1.0) of Addendum
1 that was issued. However, all bidders provided MBE and WBE Utilization Plans with quotes
from MBE and WBE subcontractors to satisfy the goals set forth in the project.

Engineering recommends award of a contract for all divisions for a total of $973,418.00 to the
lowest responsive / responsible bidder, Premium Concrete. While Premium Concrete did
submit its bid using forms which reflected the incorrect goal requirements, after review by the
City’s legal department, it was determined that the incorrect form was provided
by the City, but it did not impact Premium Concrete’s representation that it will
meet or exceed the required Minority and Women Business goals as stated in
the addenda. The error was in the form submitted, not the substance of the bid
submitted. The incorrect form was provided to all bidders and all bidders were
able to meet the M & W goals for this project.
