SUBSTITUTE BILL NO. 38-23 <br /> ORDINANCE NO. 10951-23 <br /> AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br /> INDIANA,AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED <br /> 1202 S LAFAYETTE COUNCILMANIC DISTRICT NO. 2 IN THE CITY OF SOUTH <br /> BEND, INDIANA <br /> STATEMENT OF PURPOSE AND INTENT <br /> Petitioners desire to rezone the property from I Industrial District to U3 Urban <br /> Neighborhood 3. <br /> NOW,THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, <br /> Indiana, as follows: <br /> SECTION I. Ordinance No. 10689-19, which ordinance is commonly known as the <br /> Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby amended in order <br /> that the zoning classification of the following described real estate in the City of South Bend, St. <br /> Joseph County, State of Indiana: <br /> PARCEL 1: LOTS NUMBERED EIGHTEEN (18) AND NINETEEN (19) AS SHOWN <br /> ON THE RECORDED PLAT OF SAMUEL C. STULL'S FIRST ADDITION TO THE CITY <br /> OF SOUTH BEND, RECORDING JUNE 18, 1884 IN PLAT BOOK 4, PAGE 50 IN THE <br /> OFFICE OF THE RECORDED OF ST. JOSEPH COUNTY, INDIANA. EXCEPTING 50 FEET <br /> TAKEN OFF OF AND FROM THE ENTIRE EAST SIDE OF SAID LOTS FOR THE <br /> PENNSYLVANIA RAILROAD. ; AND <br /> PARCEL 2: BEGINNING AT THE NORTHWEST CORNER OF LOT 17 AS SHOWN <br /> ON THE RECORDED PLAN OF SAMUEL C. STULL'S FIRST ADDITION TO THE CITY <br /> OF SOUTH BEND, THENCE RUNNING EAST ALONG THE NORTH LINE OF SAID LOT, <br /> 115 FEET; THENCE RUNNING SOUTH 110 FEET; THENCE RUNNING WEST 115 FEET <br /> TO THE EAST LINE OF LAFAYETTE BOULEVARD; THENCE RUNNING NORTH <br /> ALONG THE EAST LINE OF LAFAYETTE BOULEVARD, 110 FEET TO THE PLACE OF <br /> BEGINNING. <br /> COMMONLY KNOWN AS 1202 S. This ordinance is and shall be subject to commitments as provided by <br /> Chapter 21-12.07(f)(7) Commitments, if applicable. <br /> SECTION III.
