South Bend Redevelopment Commission <br />Rescheduled Regular Meeting -June 25, 2008 <br />6. NEW BUSINESS (CONT.) <br />A. Public Hearing <br />(1) continued... <br />regards to general fund expenditures. <br />Mr. King agreed that the Commission may <br />need to discuss that more before voting on <br />Resolution No. 2456. That discussion would <br />have bearing on the decision the Commission <br />makes on Resolution No. 2456. <br />Ms. Havens asked for clarification on where <br />this proposal to expand the AEDA is in the <br />process. Is Resolution No. 2456 a <br />declaratory or confirming resolution? Mr. <br />Inks responded that this would be the last <br />step in the approval process. The <br />Commission already adopted a resolution <br />proposing to add this area to the AEDA, <br />established a public hearing date, and sought <br />and received approval by the Common <br />Council. This would be the final action to <br />establish the action to expand the AEDA to <br />include Portage Prairie. <br />Ms. Havens asked if there was an Area Plan <br />Commission step prior to the Common <br />Council approval. Mr. Inks responded that <br />there was not, and there is none required by <br />state law. <br />Ms. Havens stated that there's some question <br />as to whether the hearing conducted by the <br />South Bend Common Council was legal, as <br />no one has been able to provide proof of <br />legal advertisement for that hearing. So, if <br />that meeting and hearing were subsequently <br />deemed null and void, it's possible that any <br />action the Commission takes today would <br />11 <br />
