SUBSTITUTE BILL NO. 8-87 <br /> ORDINANCE NO. 7 7 q _g'7 <br /> AN ORDINANCE AMENDING CHAPTER 4 ENTITLED LICENSES <br /> AND CHAPTER 5 ENTITLED ANIMALS AND FOWL <br /> OF THE SOUTH BEND MUNICIPAL CODE <br /> STATEMENT OF PURPOSE AND INTENT <br /> The Common Council of the City of South Bend, Indiana, believes it is <br /> in the best interests of public safety and welfare to amend certain <br /> licensing provisions of the South Bend Municipal Code in order to allow the <br /> City Controller to delegate certain licensing respsonsibilities. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF <br /> SOUTH BEND, INDIANA, AS FOLLOWS: <br /> SECTION I. Chapter 4, Article 1, Sec. 4-14(a) of the Municipal Code of the <br /> City of South Bend shall be amended to read as follows: <br /> Section 4-14. Licensing powers and duties of the Office of the City <br /> Controller. <br /> (a) The City Controller shall issue all licenses in the name of the <br /> City, except as otherwise provided herein. The City Controller shall have <br /> the authority to designate a third party to issue pet licenses. Said <br /> designation must be made by the Controller no later than the first Wednesday <br /> of each year by the filing of an appropriate Resolution with the Common Council <br /> for their consideration and approval unless said resolution designates a <br /> period of time which is consistent with the term of said contract with the <br /> third party. Any monies remaining with the third party designee from the <br /> collection of such pet licenses at the end of the calendar year shall be <br /> processed pursuant to the applicable terms of the contract then in effect <br /> between the City and the third party. <br /> SECTION II . Chapter 5, Article 5, Sec. 5-32 of the Municipal Code of the <br /> City of South Bend shall be amended to read as follows: <br /> Section 5-32. Notice of pet .registration-license required. <br /> (a) Any resident of the City who adopts a dog from the humane society, <br /> animal care facility, or any not-for-profit agency, or who purchases a dog <br /> from a for-profit business or organization must be given a copy of the "Pet <br /> Registrot4erz-f wircd"-farm-by-t-he-facili y form entitled "Pet License <br /> Required". <br /> (b) The City -Ceetr-o1le-' --Off-ee Controller or his designee shall <br /> provide "Pet Registration- License Required' forms to all such facilities on <br /> an annual basis. <br /> (c) Such forms shall be in triplicate form with the original being <br /> sent to the Ceetr-o-l.Ae-'-sr-O€f-iee City Controller or his designee by the <br /> selling or adopting facility within ten (10) days of date of purchase or <br />
