tommitt a e ort: <br /> VOW Waltz auZi Proptrty Vacation QCommitt <br /> The November 12, 2001 meeting of the Public Works and Property Vacation Committee was <br /> called to order by its Chairperson, Council Member David Varner at 4:03 p.m. in the Council <br /> Informal Meeting Room. <br /> Persons in attendance included Council Members Coleman, Varner, White, Aranowski, Kirsits, <br /> Pfeifer, Ujdak, King, and Kelly; Attorney Charles R. Shedlak, Mahmoud A. Hussein, Elizabeth <br /> Leonard, City Controller Frederick 011ett, Public Works Director Gary Gilot, Terry Bland of the <br /> 'otttj Igt110 rttltUtt and Kathy Cekanski Farrand, Council Attorney. <br /> Dr. Varner noted that the first item on the agenda was to review Substitute Bill No. 94-01 which is <br /> a request to vacate a portion of the first east/west alley south of South Bend Avenue. Dr. Varner <br /> noted that the Board of Public Works sent a favorable recommendation. Dr. Varner further noted <br /> that this Bill was continued from the October 22nd Committee meeting. <br /> Mr. Charles R. Shedlak, the attorney for Club 23 made the presentation. Mr Shedlak stated that <br /> the vacation is being requested in order to better protect the safety of the patrons of the abutting <br /> commercial establishment known as Club 23. The alley currently separates the business from the <br /> parking lot used by its patrons and is causing safety concerns. He noted that the substitute Bill <br /> addresses all of the concerns raised at the previous meeting. He further noted that he spoke <br /> directly with Tony Molnar and Carl Littrell who recommended the changes incorporated into the <br /> substitute Bill. Mr. Shedlak further noted that the business owns the property above the alley and <br /> Mr. Hussein personally owns the property below the alley. <br /> Mr. Gilot stated that he would have preferred a cut on the opposite side however the jug handle <br /> being proposed would be acceptable. <br /> Council Member King inquired about how the vacated alley would be shut off. Mr. Hussein stated <br /> that he would fence off the area immediately after they receive permission to vacate the alley. <br /> Council Member Ujdak inquired about access to a new home built east of the area in question. <br /> Council Member King noted that the Neighborhood Housing Services has protected parking. <br /> Mr. Gilot recommended that a reflectorized fence be used. Mr Hussein noted that he would put <br /> reflectorized tape on the fence. <br /> Following discussion, Council Member King made a motion, seconded by Council Member <br /> Aranowski that Bill No. 94-01 be recommended favorably. The motion passed. <br /> Under unfinished business, Dr. Varner inquired about the overall vacation process.
