This is EXHIBIT K, consisting of 2 pages, referred to in <br />and part of the Agreement between Owner and Engineer <br />for Professional Services dated Dec. 21, 2021. <br />AMENDMENT TO OWNER -ENGINEER AGREEMENT <br />Amendment No. _1 <br />1. Background Data: <br />a. Effective Date of Owner -Engineer Agreement: <br />b. Owner: Board of Public Works, City of South Bend, Indiana <br />C. Architect: RATIO Architects. LLC <br />d. Project: Morris Performing Arts Center Expansion, Parking Garage, and Plaza <br />Improvements "Project" <br />2. Description of Modifications: <br />a. The Scope of Services currently authorized to be performed by the Architect in <br />accordance with the Agreement and previous amendments, if any, is modified as <br />follows: <br />The Project Scope is revised after the Preliminary Design Phase Opinions of <br />Probable Construction Cost exceeded the Total Project Cost. The Project Scope <br />deletes the Parking Garage and adds a revised layout and minimal site <br />improvements to the existing Parking Lot adjacent to the Morris Performing Arts <br />Center. <br />The Architect is to provide Final Design Phase Services (A1.03). <br />C. For the Additional Services or the modifications to services set forth above, <br />Owner shall pay Architect the following additional or modified compensation: <br />Final Design Phase Adjusted Amount of. $470,950.00 <br />e. The schedule for rendering services is modified as follows: <br />Final Design Phase is anticipated to be completed May 2023. <br />3. Agreement Summary (Reference only) <br />a. Original Agreement amount (Final Design Phase): $ 670,000.00 <br />b. Net change for prior amendments: $ + 0- <br />c. This amendment amount: $ (+) 470,950.00 <br />d.
