Contractoragreesthathe/she/itshallenrollinandveri’theworkeligibilitystatusofallofContractor’snewlyhiredemployeesthroughtheE-VerifyProgramasdefinedbyI.e.22-5-1.7-3.Contractor’sdocmnentationofenrollmentandparticipationintheB-VerifyProgramisincludedandaltachedaspartofthisbidlquote;and5.Contractorshallrequirehis/her/itssubcontractorsperfonningworkunderthispubliccontracttoceftit3thatthesubcontractorsdonotknowinglyemployorcontractwithanunauthorizedalien,norretainanyemployeeorcontractwithapersonthatthesubcontractorsubsequentlylean-isisanunauthorizedalien,andthatthesubcontractorhasenrolledinandisparticipatingintheE-Veri&Program.TheContractoragreestomaintainthiscertificationthroughoutthetermofthecontractwiththeCityofSouthBend,andunderstandsthattheCitymayterminatethecontractfordefaultiftheContractorfailstocureabreachofthisprovisionnolaterthanthirty(30)daysafterbeingnotifiedbytheCity.6.Persons,firms,partherships,corporations,associations,orjointventurersawardedacontractbytheCityofSouthBendthroughitsagencies,boards,orcommissionsshallnotdiscriminateagainstanyemployeeorapplicantforemploymentintheperformanceofaCitycontractwithrespecttohire,tenure,terms,conditions,orprivilegesofcontractoremployment,oranymatterdirectlyorindirectlyrelatedtocontractingoremploymentbecauseofrace,sex,religion,color,nationalorigin,ancestry,genderexpression,genderidentity,sexualorientation,orduetoageordisabilitythatdoesnotaffectthatperson’sabilitytoperformthework.Inawardingcontractsforthepurchaseofwork,labor,services,supplies,equipment,materials,oranycombinationoftheforegoingincluding,butnotlimitedto,publicworkscontractsawardedunderpublicbiddinglawsorothercontractsinwhichpublicbidsarenotrequiredbylaw,theCity,itsagencies,boards,orcommissionswillconsidertheContractor’sgoodfaitheffortstoobtainparticipationbythosesubcontractorscertifiedbytheStateofIndianaasaMinorityBusiness(‘%‘2E”)orasaWomen’sBusinessEnterprise(“WBB”)asafactorindeterminingthelowest,responsible,responsivebidder.ContractorsseekingtheawardofaCitycontractcannotberequiredtoawardasubcontracttoanMWBE;however,theymaynotunlawfullydiscriminateagainstsaidtvE/WBE.Ongoal-eligiblecontracts,Contractorsarerequiredtoeithermeetboth1vIBEandWBEutilizationgoalsordemonstratethattheContractorhasmadegoodfaitheffortstoobtainparticipationfromMBEandWEEsubcontractors.AfindingofnoncomplianceoradiscriminatorypracticeshallprohibitthatContractorfrombeingawardedaCitycontractforaperiodofone(1)yearfromthedateofsuchdetermination,andsuchdeterminationmayalsobegroundsforterminatingthecontacttowhichthediscriminatorypracticeornoncompliancepertains.7.TheundersignedContractoragreesthatthefollowingnondiscriminationcommitmentshallbemadeapartofanycontractwhichitmayhenceforthenterintowiththeCityofSouthBend,Indianaoranyofitsagencies,boardsorcommissions.Contractoragreesnottodiscnminatcagainstorintimidateanyemployeeorapplicantforemploymentintheperformanceofthiscontractwithprivilegesofemployment,oranymatterdirectlyorindirectlyrelatedtoemployment,becauseofrace,religion,color,sex,genderexpression,genderidentity,sexualorientation,handicap,nationaloriginorancestry.Breachofthisprovisionmayberegardedasmaterialbreachofcontract.I,theundersignedbidderoragentascontractoronapublicworksproject,understandmystatutoryobligationstotheuseofsteelproductsorfoundryproductsmadeintheUnitedStates(IC.5-I6--l).Therebyoerti’thatIandallsubcontractorsemployedbymeforthisprojectwillusesteelproductsorfoundryproductsmadeintheUmtedStatesonthisprojectifawarded.IunderstandIhaveanaffirmativedutytonoti,theCityinmybidthatmyproposaldoesnotincludetheuseofsteelproductsorfoundryproductsmadeintheUnitedStates.IunderstanditismysoleobligationandresponsibilitytoprovideajustificationtotheCity,subjecttoreviewandapproval,whythecostofUnitedStatesmadesteelorfoundryproductsisunreasonable.PriortoawardanduponsubmissionofbidwhichdoesnotusesteelproductsorfoundryproductsmadeintheUnitedStates,theCity,throughitsdirectorofpublicworks,shallmakeadeterminationifthepriceofUnitedStatesmadesteelorfoundryisunreasonable.Iunderstandthatviolationshereunder
