APPROVAL OF PERMITS/LICENSES The following street closures and nrnr.P.ccinna xa,PVP rP- t-A r, - APPROVAL OF LICENSE APPLICATION FOR A TRANSIENT MERCHANT LICENSE RENEWAL — FAY'S MARINA INC. Mr. Gilot stated that the Board is in receipt of favorable recommendations for Fay's Marina, 909 Pine Lake Avenue, LaPorte, Indiana 46350, application for a Transient Merchant License renewal for the Michiana Boat and Sports Show to take place at the Century Center on February 1 through 3, 2013. Upon a motion made by Mr. Inks, seconded by Mr. Neal and carried, the License Application was approved. APPROVAL OF REVOCABLE PERMIT FOR ENCROACHMENT — FENCING FOR ST. JOSEPH HIGH SCHOOL Mr. Gilot stated a Revocable Permit application has been received from Danch Harper and Associates, 1643 West Commerce Drive, South Bend, Indiana 46628, on behalf of the Diocese of Ft. Wayne — South Bend, for the purpose of allowing fencing to be installed in the right-of- way along a portion of the St. Louis Street frontage of the St. Joseph High School campus; part of the southeast quarter of Section 1 and the northeast quarter of Section 12 of St. Louis Boulevard from LaSalle Boulevard to the west line of Notre Dame Avenue, Mr. Mike Danch, Danch Harper and Associates stated the request is for a portion of the ornamental fence installed by the St. Joseph High School concession stand. He noted when the fence was installed, it was thought it was back of the sidewalk right-of-way, but it was later found that the decorative columns were 3' in the right-of-way for this particular section. Mr. Inks questioned if the City is responsible for any damage or injury since it is in the right-of-way. Mr. Harper stated they are not. Mr, Gilot added that the Revocable Permit has language in it that indemnifies the City from any liability. Upon a motion made by Mr. Inks, seconded by Mr. Neal and carried, the Revocable Permit was approved.
