Upon a motion made by Mr. Inks, seconded by Mr. Neal and carried, the <br />License Application was approved. <br />APPROVAL OF REVOCABLE PERMIT FOR ENCROACHMENT — FENCING FOR ST. <br />JOSEPH HIGH SCHOOL <br />Mr. Gilot stated a Revocable Permit application has been received from Danch Harper and <br />Associates, 1643 West Commerce Drive, South Bend, Indiana 46628, on behalf of the Diocese <br />of Ft. Wayne — South Bend, for the purpose of allowing fencing to be installed in the right-of- <br />way along a portion of the St. Louis Street frontage of the St. Joseph High School campus; part <br />of the southeast quarter of Section 1 and the northeast quarter of Section 12 of St. Louis <br />Boulevard from LaSalle Boulevard to the west line of Notre Dame Avenue, Mr. Mike Danch, <br />Danch Harper and Associates stated the request is for a portion of the ornamental fence installed <br />by the St. Joseph High School concession stand. He noted when the fence was installed, it was <br />thought it was back of the sidewalk right-of-way, but it was later found that the decorative <br />columns were 3' in the right-of-way for this particular section. Mr. Inks questioned if the City is <br />responsible for any damage or injury since it is in the right-of-way. Mr. Harper stated they are <br />not. Mr, Gilot added that the Revocable Permit has language in it that indemnifies the City from <br />any liability. Upon a motion made by Mr. Inks, seconded by Mr. Neal and carried, the Revocable <br />Permit was approved. <br />
