INTER-OFFICE MEMORANDUM <br /> <br /> Department of Law City of South Bend 227 W Jefferson Blvd <br /> <br />TO: Board of Public Works, Theresa Heffner, Michael Schmidt <br />FROM: Jenna Throw, Assistant City Attorney <br />SUBJECT: AEP Easement <br />DATE: February 21, 2022 <br /> <br /> <br />Members of the Board, Ms. Heffner, and Mr. Schmidt: <br /> <br />AEP has requested an easement over two parcels of property owned by the Civil City of South <br />Bend which are part of Ponader Park for electric transmission, distribution, and communication <br />lines and appurtenant equipment and fixtures. The Board of Park Commissioners is expected to <br />approve these easements over park property at its February 22, 2023 meeting. The Board has <br />already approved the Easement labeled Easement No. 63 in concept at its August 15, 2022 <br />meeting, and Easement No. 65 is part of the same project. The Board of Park Commissioners is <br />also expected to sign two other easements over parcels titled to the Parks at Boehm Park and <br />Booth Tarkington Park at its February 22nd meeting. However, the parcels for Easements 63 and <br />65 are currently titled to the City, rather than the Parks Department or the Board of Park <br />Commissioners. As the Board of Public Works is the holder of real property owned by the City, <br />we request that the Board approve this Easement. <br /> <br />
