INTER-OFFICE MEMORANDUM Department of Law City of South Bend 227 W Jefferson Blvd TO: Board of Public Works, Theresa Heffner, Michael Schmidt FROM: Jenna Throw, Assistant City Attorney SUBJECT: AEP Easement DATE: February 21, 2022 Members of the Board, Ms. Heffner, and Mr. Schmidt: AEP has requested an easement over two parcels of property owned by the Civil City of South Bend which are part of Ponader Park for electric transmission, distribution, and communication lines and appurtenant equipment and fixtures. The Board of Park Commissioners is expected to approve these easements over park property at its February 22, 2023 meeting. The Board has already approved the Easement labeled Easement No. 63 in concept at its August 15, 2022 meeting, and Easement No. 65 is part of the same project. The Board of Park Commissioners is also expected to sign two other easements over parcels titled to the Parks at Boehm Park and Booth Tarkington Park at its February 22nd meeting. However, the parcels for Easements 63 and 65 are currently titled to the City, rather than the Parks Department or the Board of Park Commissioners. As the Board of Public Works is the holder of real property owned by the City, we request that the Board approve this Easement.
