(5) Sanc_tions__for_ Noncompliance_ In the event of the EHGINEER's <br />noncompliance with the nondiscrimination provisions of this <br />Agreement, the CITY shall impose such contract sanctions as it, the - <br />State or the Federal Government may determine to the appropriate, <br />including, .but not limited to: <br />~°' (a) withholding of payments tithe ENGINEER under the Agreement <br />until the EKGIHEER complies, and/or <br />(b) cancellation, termination or suspension of .the Agreement, in <br />whole or in part. <br />(6) Incorporation of_Prov_isione_ .The ENGINEER vill include the <br />provisions of this Appendix "A" in every subcontract, including <br />procurements of materials and leases of equipment, unless exempt by <br />the Regulations, or directives issued pursuant thereto. The <br />ENGINEER vial take such action with respect to any Subcontract or <br />procurement as the CITY, .State or the Federal Government may direct <br />as a means of enforcing such provisions including sanctions for <br />noncompliance; provided,- however, that, in the event the ENGINEER <br />becomes involved in, cr is threatened with, litigation vith a <br />subcontractor or supplier as a result of such direction, the <br />ENGINEER may request the CITY to enter into such litigation to <br />protect the. interests of the CITY, and, in addition, the ENGINEER <br />may request the State of Indiana and/or the United States to enter <br />such litigation to protect the interests of the State of Indiana <br />and/or the United States. <br />Page 19 <br /> <br />
