Comm sport: <br /> The Zoning and Annexation Committee <br /> go the tommott tOtttttfl of t t City of outhj /40: <br /> The May 10, 1999 meeting of the Zoning and Annexation Committee was called to order <br /> by Council Member Charlotte Pfeifer, Vice-Chairperson at 4:05 p.m. in the Council <br /> informal meeting room. <br /> Persons in attendance included Council Members: Aranowski, King, Varner, Kelly, <br /> Pfeifer, Sniadecki and Coleman; Terry Bland, John Byorni, Lew Powell, Carl Littrell, <br /> Robert Forrest, Bob Palmiter, Larry Magliozzi, Ron Johnson, Catherine M. Brucker and <br /> Kathleen Cekanski-Farrand. <br /> Council Member Pfeifer noted that the first item on the agenda was Bill No. 26-99 which <br /> would annex and amend the zoning ordinance for certain property located in German <br /> Township, commonly referred to as the Fiskars Properties, Inc., No. 2, 23870 Brick <br /> Road, South Bend, Indiana 46628. <br /> Mr. Magliozzi noted that the Bill is a voluntary annexation of approximately one-half acre <br /> of property. The Council will also be reviewing its Fiscal Plan attached to Resolution No. <br /> 99-36(attached). <br /> Mr. Byorni noted that the Bill received a favorably recommendation from the Area Plan <br /> Commission as well as the staff of the APC. <br /> Mr. Palmiter, the petitioner, noted that the rezoning and annexation would allow the <br /> expansion of his building to seven (7)pods along with increased parking areas. <br /> Following discussion, Council Member Kelly, made a motion, seconded by Council <br /> Member Varner, that Bill No. 26-99 be recommended favorably to Council. The motion <br /> passed. <br /> The Committee then reviewed Substitute Bill No. 17-99 which is a rezoning request for the <br /> property located at 1158 Lincoln Way East. Mr. Byorni noted that both the staff and the <br /> Area Plan Commission gave favorable recommendations to this request. <br /> Ron Johnson, the petitioner, made the presentation. He noted that the building, if <br /> approved,would become the law offices of Attorney Joseph Rubin. <br /> Following discussion, Council Member Varner made a motion, seconded by Council <br /> Member Kelly,that Substitute Bill No. 17-99 be recommended favorably to Council. The <br /> motion P assed. <br /> The Committee then reviewed Substitute Bill No. 27-99 which would amend Chapter 21 of <br /> the South Bend Municipal Code, § 21-12.040. Mr. Byorni noted that the Bill is initiated <br /> by the Area Plan Commission and would allow accessory buildings in the "0" Office <br /> zoning classification. Total accessory structures would be limited to 576 square feet or the <br /> existing structure. The Council Attorney noted that the Substitute version includes a height <br /> restriction of fourteen (14') feet. Mr. Byorni noted that this height restriction was <br /> requested by Don Fozo,the Building Commissioner. , <br />
