, <br /> Committee sport: <br /> The Zoning and Annexation Committee <br /> 'Co the Common Countil of the City of bouth nb: <br /> The June 28, 1999 meeting of the Zoning and Annexation Committee was called to order <br /> by Council Member John Hosinski, Chairperson, at 4:05 p.m. in the Council informal <br /> meeting room. <br /> Persons in attendance included Council Members:Aranowski, Varner, Hosinski, Ujdak, <br /> Coleman, Kelly, Pfeifer, King and Sniadecki; Larry Magliozzi, Robert Hunt, Kathleen <br /> Cekanski-Farrand and Terry Bland. <br /> Council Member Hosinski noted that the petitioner has been requested that Bill No. 41-99 <br /> which is the proposed historic landmark designation for the property located at 125 West <br /> Marion Street be continued indefinitely. <br /> Council Member Hosinski then called upon Larry Magliozzi to provide an overview of state <br /> law changes to the annexation laws. <br /> Mr. Magliozzi noted that he provided a memorandum addressing this topic earlier to the <br /> Council. He then highlighted some of the basic changes which include: <br /> 1. Changing the"typical annexation" from a 3 month process to a 6 month process <br /> which includes separating the 2d and 3rd readings at different Council meetings. <br /> 2. Having four (4) contacts with the Council instead of the current two (2), which <br /> would include the Resolution on the Fiscal Plan; 1st reading on the ordinance followed by a <br /> 60 day wait; 2d reading and public hearing followed by a 30 to 60 day wait; and third <br /> reading and final vote at a separate Council meeting. <br /> 3. Providing that there be a three(3) year maximum period of time going forward <br /> in time for which an effective date for an annexation may take place. <br /> 4. Providing that the remonstrance in St. Joseph County remains at 50% while the <br /> rest of the state will be established at 65%. <br /> 5. Providing that additional property taxes would be impounded with a special <br /> advisory board being established to overview such funds. <br /> 6. Providing that the period of time to re-file an annexation will be changed from <br /> three(3)years to four(4)years. <br /> 7. Requiring filings with the Secretary of State's Office. <br /> The Council Attorney suggested that Mr.Magliozzi contact the City Clerk's Office <br /> contacted so that at the first contact addressing the fiscal plan and resolution stage,that such <br /> matters automatically be sent to the Zoning and Annexation Committee for review and <br /> recommendation. She also added that the change in the remonstrance percentage will be <br /> addressed by her with the legal department as a potential constitutional challenge based on <br /> equal protection to the 50% requirement currently in effect for St.Joseph County. <br />
