Q.ommittet Ztport: <br /> The Zoning and Annexation Committee <br /> to the Qtommoit Co until of he eitp of South ‘10: <br /> The July 26, 1999 meeting of the Zoning and Annexation Committee was called to order by <br /> Council Member John Hosinski, Chairperson, at 4:25 p.m. in the Council informal <br /> meeting room. <br /> Persons in attendance included Council Members: Aranowski, Varner, Hosinski, Ujdak, <br /> Coleman, Kelly, Pfeifer, King and Sniadecki; John Broden, Beth Leonard, Jon Hunt, <br /> Travis Parker, Gerald Kline, Doug Carpender, Cindy Hazel, concerned citizens living in <br /> the Marquette Avenue area,Kathleen Cekanski-Farrand and Terry Bland. <br /> Council Member Hosinski noted that the first item on the agenda was to review Bill.No. <br /> 41-98 which is a rezoning request for the properties located between Sample and Tutt <br /> Streets from Main Street west to the 1st north/south alley west of Main Street. <br /> Travis Parker of the Area Plan staff noted that the Bill comes with unfavorable <br /> recommendations from the staff and the Area Plan Commission. <br /> Mr.Hunt noted that there are potential private developments for this area. C uncil Member <br /> Hosinski, the sponsor of the Bill, recommended that it be continued until September 14, <br /> 1999. <br /> Under miscellaneous business, Council Member Hosinski noted that several residents on <br /> Marquette Avenue and the North Shore Triangle Area have contacted him regarding an <br /> improper group home in violation of the zoning code. He noted that several of those <br /> residents are here today and would like to be heard. <br /> Cindy Hazel noted that she lives east of the property in question. 5-6 people live in the <br /> home. It is in deteriorating condition. The residents are transients and do not take care of <br /> their dogs,are known to use alcohol to excess and have caused considerable problems with <br /> the number of vehicles parking near the home. <br /> Gerald Kline noted that he lives behind the property in question. He noted that the transient <br /> residents pay rent. He does not believe the current use for the property is consistent with <br /> the City's zoning code. Mr. Kline stated that he has called Code Enforcement for over two <br /> (2)years with no results. He has even been asked by Code Enforcement employees to get <br /> vehicle licenses. <br /> Council Member King,the District Council Member for the affected area noted that what <br /> has been described does not constitute a "group home" under the Indiana Code which are <br /> limited to "developmental/mental disabled"individuals. <br /> City Attorney John Broden suggested that a Code Enforcement hearing be set for next <br /> Tuesday,August 3rd, if at all possible. He noted that appeals of zoning matters are heard <br /> by the Board of Zoning Appeals. <br /> Citizen member Doug Carpender questioned whether complaints of this kind are funnelled <br /> to Code Enforcement employees who are familiar with the zoning code. He believes that <br /> this is an ongoing problem and that that department should be cross-trained in several <br /> areas. <br />
