tommittu *.sport: <br /> Public Works and Property Vacation Committee <br /> Ujt QCOmmon QCoutttil of tljt City of South %Ben : <br /> The November 9, 1998 meeting of the Public Works and Property Vacation Committee <br /> was called to order by its Chairperson, Council Member David Varner at 3:33 p.m. in the <br /> Council informal meeting room. <br /> Persons in attendance included Council Members: Aranowski,Kelly, Varner,Ujdak, and <br /> Hosinski;Robert Hunt,James Voll,Bill R.Owen,and Kathleen Cekanski-Farrand. <br /> Council Member Varner noted that the first item on the agenda was to review Bill No. 77- <br /> 98 which is a request to vacate six (6) alleys and three (3) streets in the Homeland 3rd <br /> Addition and the Richland 2nd Addition. Dr. Varner noted that the Board of Public Works <br /> gave a favorable recommendation to the proposal. <br /> Mr. Bill R. Owen, President of Bosh Design Group,Inc. made the presentation. He noted <br /> that the Bill was filed on behalf of Michael Urbanski of G & M Properties to replat the <br /> subdivisions to create more available lots and larger buildable lots for development. He <br /> noted that the alleys and streets proposed to be vacated are paper rights-of-ways and are <br /> not in use. <br /> Council Member Hosinski noted that in addition to the standard "savings clause" (located in <br /> § II of the Bill) which reserves the rights and easements of all utilities and the city, that <br /> applicable state law also provides for such protection. (applicable state law is Indiana Code <br /> § 36-7-3-12). <br /> Following discussion, Council Member Aranowski made a motion, seconded by Council <br /> Member Udjak, that Bill No. 77-98 be recommended favorably to Council. The motion <br /> passed. <br /> Under miscellaneous business, Dr. Varner noted that he would be contacting Lewis <br /> Powell,Director of Public Works to stress the need for defining private fire hydrants in any <br /> upcoming legislation coming before the Common Council. <br /> There being no further business to come before the Committee,the meeting was adjourned <br /> at 3:40 p.m. <br /> Respectfully submitted, <br /> Council Member David Varner <br /> Chairperson,Public Works and Property Vacation Committee <br /> Attachments <br /> • <br />
