£ommitt$t ltpOrt: <br /> Public Works and Property Vacation Committee <br /> 'go tYjt COmm0n Lountil of the City of Dout1j snb: <br /> The July 27, 1998 meeting of the Public Works and Property Vacation Committee was <br /> called to order by its Chairperson, Council Member David Varner at 4:02 p.m. in the <br /> Council informal meeting room. <br /> Persons in attendance included Council Members: Aranowski, Kelly, Varner, Coleman, <br /> Pfeifer, and Broden; Lewis Powell, Jon Hunt, Bob Hunt, Ann Kolata, Stephen D. <br /> Rudisell of Abonmarche Consultants, Inc., Mr. Dennis Brennan and Kathleen Cekanski- <br /> Farrand. <br /> Council Member Varner noted that the first item on the agenda was to review Bill No. 54- <br /> 98 requesting a vacation of various streets and alleys involving High Street, Conrail, Rush <br /> and Pennsylvania. Dr. Varner noted that the request received a favorable recommendation <br /> from the Board of Public Works at its meeting earlier today (copy attached). <br /> Stephen D. Rudisell made the presentation on behalf of the petitioner. He noted that the <br /> proposed vacation is in the Southeast Neighborhood and would permit the building of <br /> twenty (20) homes in Section I and thirteen (13) homes in Section II. Mr. Rudisell noted <br /> that the legal description would have to be amended. <br /> The Council Attorney requested that a Substitute Bill be offered by the Petitioner for this <br /> evening's meeting. Mr. Rudisell stated that he would have a substitute bill by tonight. <br /> Ann Kolata spoke in favor of the proposed vacation. <br /> Following discussion, Council Member Aranowski made a motion, seconded by Council <br /> Member Broden that Bill No. 54-98 (as amended by substitution to be filed) be <br /> recommended favorably to Council. The motion passed. <br /> The Committee then reviewed Bill No. 52-98 which is a continuance from the last Council <br /> Meeting requesting an alley to be vacated south of Prairie Avenue. Dr. Varner noted that <br /> the Board of Public Works at its meeting of July 13, 1998 made a favorable <br /> recommendation with regard to this request. <br /> The Council Attorney noted that Mr.James Voll of the Area Plan Staff confirmed that Mr. <br /> Byorni made a site visit of the proposed area and found that there would not be an ingress <br /> or egress problem with regard to the garage owned by Mr. Bueno. She further noted that <br /> the July 2, 1998 letter written by the APC staff(attached) was written based on an aerial <br /> review of the subject property. <br /> Mr. Dennis Brennan noted that he had presented photographs at the last Committee <br /> meeting of the subject property. He noted that nothing has changed since those were taken. <br /> Mr. further noted that Mr. Bueno would like to have the entire alley. His garage has two <br /> (2) doors and as a result would not have an ingress/egress problem if the vacation is <br /> granted. He further noted that the alley in question has not been used for over 40 years. <br />
