Commttte *oat: Public Works and Property Vacation Committee o tbir QCommott Coun ti of t (City of ipoutb tf: The July 13, 1998 meeting of the Public Works and Property Vacation Committee was called to order by its chairperson, Council Member David Varner at 5:05 p.m. in the Council informal meeting room. Persons in attendance included Council Members: Aranowski, Pfeifer, Kelly, Broden, Varner, Ujdak, Coleman, and Sniadecki; T. Brooks Brademas, Ralph Layne, Monty Layne, Dennis Brennan, Eugenia Schwartz, Bob Hunt, Mr. Bueno and his family, and Kathleen Cekanski-Farrand. The primary item on the agenda is to review Bill No. 52-98, which is a request to vacate an alley south of Prairie. Mr. Dennis Brennan made the presentation on behalf of the petitioners, the Layne family. He showed photographs of the proposed vacation. He noted that there are two entrances to the Bueno garage. That due to the guide wire to the utility pole, it would be impossible to enter the garage. The petitioners believe that the vacation is necessary to improve the health and safety of the neighborhood and would propose to have a fence installed if the proposed vacation is approved. Mr. Bueno spoke in opposition. He noted that he is on the property at 1819 Swigert Street for the past five years. He too showed pictures of his garage and noted that he starts his tractor there. He noted that due to vandalism, he has permanently shut the southside door. He noted that he infrequently uses the garage for his vehicle. Council Member Ujdak questioned whether the staff had visited the site in question. It was noted that the Board of Public Works did not visit the site, however, did send the proposed vacation to the Council with a favorable recommendation. After much discussion, Dr. Varner suggested that perhaps the bill be continued to allow the site evaluation by the Council as well as by the Area Plan Staff. The Council attorney noted that the continuance must be requested by the petitioner in light of the 30-day requirement of state law. After consulting with his client, Mr. Brennan requested that the petition be continued to the next Common Council meeting. Following the discussion, Council Member Ujdak made the motion, seconded by Council Member Aranowski, that Bill No. 52-98 be recommended to be continued until the Council meeting of July 27, 1998, and that it be referred back to the Area Plan Staff for review and recommendation with a site evaluation.
