<br /> <br /> <br />INTER-OFFICE MEMORANDUM <br /> <br /> DEPARTMENT OF PUBLIC WORKS <br /> DIVISION OF ENGINEERING <br /> <br /> <br />TO: Theresa Heffner, Board Clerk <br />Board of Public Works <br />FROM: Becca Plantz, Project Engineer <br />SUBJECT: Award Project No. 121-066 <br />Martin Luther King Jr. Center Demolition <br />DATE: December 14, 2022 On December 14, 2022, the Board of Public Works opened and read bids for the above project. <br />I have reviewed them and found the tabulations correct. <br /> <br />The bidders are summarized as follows: <br />Bidder Base Bid Amount <br />Alternate 1 – Lead & <br />Asbestos Abatement <br />Unit Price <br />C&E Excavating, Inc. $ 278,875.00 $ - <br />Ritschard Brothers, Inc. $ 292,110.00 $ 60/ LF <br />Green Demolition Contractors, Inc. $ 398,800.00 $ 60/ LF <br /> <br />In reviewing the required documentation, I recommend rejection of the lowest bid from C&E <br />Excavating, Inc. Based on the conclusions of Engineering, Legal, and the Contract Compliance, <br />C&E failed to meet the WBE participation goal of 4.6% and did not meet the good faith efforts <br />standards to obtain WBE participation. There were follow-up discussions with the bidder, and <br />the review indicates that good faith efforts were not met as to the WBE goal of the project. The <br />City of South Bend’s Minority and Women Business Enterprise Inclusion Program Plan states <br />when determining whether a bidder has made good faith efforts, the performance of other <br />bidders in meeting the contract goal may be considered. All other bids received were able to <br />select portions of the contract to meet the WBE goal. Therefore, the good faith effort is not <br />accepted for the affirmation contained in Form WBE-2.0, “I affirm that I have made good faith <br />efforts to select portions of the contract work to be performed by WBEs, including, where <br />appropriate, breaking out contract work items into economically feasible units to facilitate WBE <br />participation.” <br /> <br />For the above reasons, I recommend award of the base bid for Martin Luther King Jr. Center <br />Demolition to the lowest responsive / responsible bidder, Ritschard Brothers in the amount of <br />$292,110.00.
