Eommitttt Z*port: <br /> Zoning and Annexation Committee <br /> to tbt €ommott Qtoutttil of tbt eitg of foutij latub: <br /> The August 11, 1997 meeting of the Zoning and Annexation Committee was called to order <br /> by its Chairperson, Council Member John Hosinski at 3:30 p.m. in the Council informal <br /> meeting room. <br /> Persons in attendance included Council Members: Coleman, Hosinski, Varner, <br /> Aranowski, Ujdak, Pfeifer, and Broden; Don Fozo, Don Porter, Carl Littrell, Gerald <br /> Longerot,Phil St. Clair,Ann-Carol Simons,and Kathleen Cekanski-Farrand. <br /> Council Member Hosinski noted that the first item on the agenda was to review Bill No. <br /> 97-44 which is a petition from the Board of Zoning Appeals for the property located at <br /> 1945 East Randolph St. Mr. Gerald Longerot the petitioner made the presentation. He <br /> noted that he is requisition a special exception in order to permit a off-cite parking on <br /> residential property. He showed a preliminary site plan and pictures of the area in <br /> question. <br /> Mr. Carl Littrell spoke in favor of the proposed exception. Mr. Don Fozo, Building <br /> Commissioner, spoke in favor of the proposed special exception noting that the Board of <br /> Zoning Appeals recommended the petition favorably to Council and its meeting of June 19, <br /> 1997. <br /> Followin g discussion, Council Member Broden made a motion seconded by Council <br /> � y <br /> Member Varner that Bill No. 97-44 be recommended favorably to Council. <br /> Y <br /> The motion <br /> passed. <br /> Under miscellaneous business council Member Broden discussed Bill No. 69-97 which <br /> was referred by the South Bend Common Council to the Area Plan Commission at its <br /> meeting of the July 14, 1997. He noted that this bill is a zoning text amendment addressing <br /> adult care homes in residential area. He noted that it would call for the petitioner to petition <br /> the Board of Zoning Appeals for a special exception first. He has been approached by a <br /> person who lives in the fourth district interested in this area. <br /> The Council Attorney noted that state law requires a majority of the Common Council to <br /> recommend such text amendments to zoning ordinances to the Area Plan Commission and <br /> that such action would be in order to comply with the state law. <br /> Following discussion, Council Member Pfeifer made a motion seconded by Council <br /> Member Varner that Bill No. 69-97 be recommended to the Area Plan Commission on <br /> behalf of a majority of the South Bend Common Council for text amendment review. The <br /> motion passed. <br /> Council Member Hosinski then brought to the committee's attention Bill No. 77-97 which <br /> is a text amendment to the parking regulation set forth in the Zoning Ordinance. Again <br /> similar to Council Member Broden's request, a majority of the Common Council must <br /> petition the Area Plan Commission in order to have the Area Plan Commission take action <br /> on the proposed measure. Council Member Hosinski noted that the proposed bill would <br /> expand the exception to parking in the East Bank area. • <br />
