6O-menitte& gic, ore.' <br /> Public Works and Property Vacation Committee <br /> 90- t!w ammo o, t?oraacd gf t/ca JoutA Om& <br /> The June 9,1997 meeting of the Public Works and Property Vacation Committee was called <br /> to order by its Chairperson, Council Member David Varner at 4:00 in the Council informal <br /> meeting room. <br /> Persons in attendance included Council Members: Aranowski, Ujdak, Varner, Coleman, <br /> Broden, Pfeifer, and Hosinski; Larry Spalding, John Byorni, Don Fozo, James Voll, <br /> Bernie Feeney, Terry Bland, Mitch Heppenheimer, Mike Anastasio, Jon Hunt, Ann <br /> Bruneel and Kathy Cekanski-Farrand. <br /> Dr. Varner noted that the first item on agenda was to review Bill No. 44-97 which is a <br /> street vacation involving Tudor Lane. Dr. Varner noted that the bill received an <br /> unfavorable recommendation from the Board of Public Woks and Safety. <br /> Mr.Mike Anastasio the attorney on behalf of the petitioners,Mary Joe Anastasio and Irene <br /> Millar, made the presentation. He noted that the street is currently a stub street on paper. <br /> He noted that both of the petitioners are in failing health and believe that the vacation should <br /> take place as set forth for the reasons described in section IV of the proposed bill. <br /> Mr.Larry Spalding of the Engineering Department stated that the stub street is planted for <br /> development purposes and if it would be vacated it would hinder development in the future. <br /> He proposed that a vacation should be subject to a minimum of a fifty foot easement for <br /> utilities. Ann Bruneel of the Legal Department stated that currently there are no existing <br /> utilities and that a blanket easement would provide access for future utilities locating in the <br /> area. Mr.Jon Hunt noted that his department objects to the vacation and believes that the <br /> area is prime for residential development. <br /> Mr.Mitch Heppenheimer the attorney for Mr. Charles Kalawitz who owns 8.2 acres to the <br /> east stated that his client is against the vacation. He stated that the area is prime land within <br /> the city limits for residential development. <br /> In response to a question raised to Dr. Varner it was noted that there are a number of cul- <br /> de-sacs throughout the fifth district however current subdivision standards do not allow <br /> future cul-de-sacs. Mr. John Byorni of the Area Plan staff stated that their department is <br /> against the proposed vacation since it would deter residential development. <br /> Council Member Hosinski stated that the best use for the area in question is residential and <br /> that he is against the proposed vacation. <br /> Council Member Coleman voiced concern similar to those raised by the staff of the Area <br /> Plan Staff as did Council Member Varner. <br /> Following further discussion, Council Member Aranowski made a motion seconded by <br /> Council Member Ujdak that Bill No. 44-97 be recommended unfavorably. The motion <br /> passed. <br />
