atommf ttss Z port: <br /> Public Works and Property Vacation Committee <br /> to Os Common COMIC ti of tbs Cttg of *outs Osttb: <br /> The July 22, 1996 meeting of the Public Works and Property Vacation Committee was <br /> called to order by its Chairperson, Council Member David Varner at 3:35 P.M. in the <br /> Council informal meeting room. <br /> Persons in attendance included Council President Kelly,Council Members Luecke,Pfeifer, <br /> and Varner, Kevin Hamel,Ken Fetter,Don Porter,and Kathleen Cekanski-Farrand. <br /> The only item on the agenda was to review Bill No. 26-96 which is a request to vacate <br /> certain property near Sunnymede Avenue. <br /> Mr. Kevin Hamel,the petitioner,made the presentation.Mr.Hamel noted that this bill has <br /> been continued on several occasions in light of the opposition voiced originally by the <br /> South Bend School Corporation.He noted that he had been in contact with the South Bend <br /> School Corporation as well as the Council Attorney and all parties were able to amicably <br /> resolve the School Corporation's concern. He then presented a letter dated July 18,1996 <br /> addressed to Council President Kelly (copy attached) which specifically notes that the <br /> South Bend Community School Corporation withdrew any objection to the alley vacation. <br /> Also included was a quitclaim deed providing access to the subject property of the School <br /> Corporation. <br /> Council Member Luecke noted that the Board of Public Works originally sent a negative <br /> recommendation which was not binding on the council It was noted by the Council <br /> Attorney that all parties were satisfied in going forward with the proposed vacation. <br /> In light of the fact that there is not a quorum present no formal action on Bill No. 26-96 <br /> could be taken legally. <br /> There being no further business come before the committee the meeting was adjourned at <br /> 3:40 p.m. <br /> Respectfully submitted, <br /> Council Member David Varner <br /> Chairperson,Public Works and Property Vacation Committee <br /> Attachments <br /> • <br />
