• hereto, have the meanings herein specified, unless the context <br />otherwise requires: <br />(a) "Agreement" or "this Agreement" means this <br />instrument, either as originally executed or as it may from. time <br />to time be supplemented, modified or amended by any supplemental <br />agreement entered into pursuant to the provisions of this <br />Agreement. <br />(b) "Arbitrage Regulations" means the Treasury <br />Regulations under Section 148 of the Code, as the same may be <br />amended or supplemented or proposed to be amended or supplemented <br />from time to time. <br />(c) "Authority" means the South Bend Redevelopment <br />Authority, a body corporate and politic, or any successor entity. <br />Authority. <br />(d) "Board" means the Board of Directors of the <br />(e) "Bond" or "Bonds" (unless the context shall <br />otherwise require) means any Bond or Bonds, or all the Bonds, as <br />the case may be, authenticated and delivered under this Agreement. <br />(f) "Bondholder," "holder," "owner" and "registered <br />owner" means the registered owner of a Bond. <br />• (g) "Code" means the Internal Revenue Code of 1986, as <br />amended. <br />(h) "Commission" means the South Bend Redevelopment <br />Commission, or if said commission shall be abolished, the <br />commission, board, body or agency succeeding to the principal <br />functions thereof. <br />(i) "Construction Fund" means the Construction Fund <br />created and established by Section 3.01. <br />(j) "Government Obligations" means bonds, notes, <br />certificates of indebtedness, treasury bills or other securities <br />constituting direct obligations of, or obligations the timely <br />payment of the principal of and the interest on which are fully and <br />unconditionally guaranteed by, the United States of America or any <br />agency or instrumentally thereof when such obligations are backed <br />by the full faith and credit of the United States of America. <br />(k) "Lease" means the lease by the Authority to the <br />Commission, dated as of August 1, 1990, as the same may be amended <br />or supplemented. <br />• -3- <br />
