~ ~ ) <br />EXHIBIT A <br />AGENCY AGREEMENT. <br />This Agency Agreement ("Agency Agreement"), made and <br />entered into as of the ~ day of December, 1990, by the South <br />Bend Redevelopment Authority (the "Authority") and the City of <br />South Bend, Indiana, a municipal corporation duly organized and <br />existing pursuant to the laws of the State of Indiana acting by and <br />through its Board of Public Works (the "Board of Public Works"), <br />for purposes of the Authority .designating the Board of Public Works <br />to act as its agent for purposes of constructing certain public <br />improvements (the "Project") and other matters related thereto. <br />W I T N E S S E T H: <br />.WHEREAS, the Authority at a meeting on August 30, 1990, <br />adopted Resolution No. 24 approving a proposed Lease for the <br />Project (the "Lease"), a copy of which Lease is attached hereto as <br />"Exhibit A", between the Authority and the South Bend Redevelopment <br />Commission (the "Commission") to be dated as of August 1, 1990, <br />and plans, specifications and cost estimates for the Project, and <br />directing the Secretary of the Authority to file a copy of said <br />Lease with the Commission; and <br />WHEREAS, the Commission at a meeting on August 31, 1990, <br />adopted Resolution No. 957 approving said Lease and plans, <br />specifications and cost estimates for the Project, scheduling a <br />public hearing on said Lease to be held on September 14, 1990, and <br />authorizing the publication of a notice of public hearing on said <br />Lease, pursuant to IC 5-3-1; and <br />CJ <br />
