Committee Z port: <br /> Zoning and Annexation Committee <br /> IT0 Mt COmmOtt Council of the City of griouUj *n : <br /> The September 23, 1996 meeting of the Zoning and Annexation Committee was called to <br /> order by its Vice Chairperson, Dr. Varner, at 4:02 p.m. in the Council informal meeting <br /> room. <br /> Persons in attendance included Council Members: Luecke, Kelly, Varner, Coleman, <br /> Broden,Washington, and Pfeifer; Kathy Dempsey, John Byorni, John Oxian, Don Porter <br /> and Kathleen Cekanski-Farrand. <br /> Dr. Varner noted that the only item on the agenda was to review Substitute Bill No. 90-93 <br /> addressing the t e Historic Preservation Commission. Mr.Oxian, the President of the Historic <br /> Preservation Commission deferred to the Council Attorney. The Council Attorney <br /> indicated that the Bill had been filed on October 25, 1993 and went before the Area Plan <br /> Commission at its meeting of May 17, 1994 where it received an unfavorable <br /> recommendation. The purpose of the Bill would be to permit the Common Council to <br /> extend the time period from one year to three years when the Historic Preservation <br /> Commission properly petitions the Council for a continuation in the delay in the issuance of <br /> a permit for construction, reconstruction, alteration, demolition, or the moving of a <br /> designated historic landmark. She noted that the Council Member who filed the original <br /> Bill is no longer with the Council. She also indicated that she had copies of the excerpts of <br /> the Area Plan Commission meeting as well as the letter from the Area Plan staff, and had <br /> met with the Area Plan staff as well as the Legal Department on this issue. <br /> The Council Attorney then noted that she had discussions earlier today with Mr. Oxian and <br /> informed him that it was her opinion that the current Ordinance permits the Historic <br /> Preservation Commission to re-petition the Council for the same designated historic <br /> landmark and that there was not a limitation to the number of times for this. She also <br /> indicated that the three-prong test set forth in Section 21-1-17.2 must be met in each <br /> instance by the Commission in order for the Council to grant the Commission's request. <br /> Based on that information, Mr. Oxian stated that he would request to withdraw the <br /> Substitute Bill. The Council Attorney noted that the proper Motion at this evening's <br /> Common Council meeting would be to strike Substitute Bill No. 90-93 from the agenda. <br /> There being no further business to come before the Committee the meeting was adjourned <br /> at 4:10 P.M. <br /> Respectfully submitted, <br /> Council Member David Varner,Vice Chairperson <br /> Zoning and Annexation Committee <br /> Attachments <br /> • <br />
